Ohio Senate should bury bill to permit concealed weapons in bars: editorial

Now pending in the state Senate, that carnival of Columbus lunacy, is a bill to let Ohioans with concealed handgun permits carry their weapons in bars and restaurants licensed to serve alcoholic beverages.

Booze and guns: A stupider idea and deadlier mix can hardly be imagined. Yet a dozen senators (including Geauga County Republican Timothy Grendell, suburban Youngstown Democrat Capri Cafaro and Republican secretary of state candidate Jon Husted, a suburban Dayton Republican) think it would be dandy.

The proposal is pending in a Senate committee. It should never see the light of day.

''----''--Even if there were any need for this measure -- which there is not -- Ohio has far more pressing items on its agenda, starting with 11 percent unemployment.

The solution to that isn't more guns in more places but instead a Senate that is focused on Ohio's real needs rather than on pandering to a lobby that cannot be satisfied. The gun lobby is insatiable because if its demands ever were met, the lobby would be out of work -- like too many other Ohioans, as the Senate spins its wheels, already are.

Grendell is my state senator. Cafaro doesn't know squat about most issues.

This bill sounds like something that coke dealers would want.

3. You can carry in bars/restaurants in many states as long as you aren't drinking
There are no bloodbaths in those states. Can you point me to a link indicating otherwise?

And I'd bet we don't have more bar shootings than Ohio. And in cases where there are shootings in bar they usually already have a rep as a nuisance bar and in many cases get shut down by state liquor control.

While I do feel for your loss, the problem does not seem to be those carying legally for self-protection under all applicable laws.

Note that Arizona has not suffered a rash of bar/restaurant shootings since legalizing it back in... September, I think.


And again, does not seem to be a problem elsewhere.

Why shouldn't one be able to carry into a restaurant like an Applebee's, TGIFriday's, or your local Italian place just cause they serve evil alchohol? The idiots that shoot one another in bars aren't usually the law-abiding folks anyway. Most of them are carrying illegally.

You won't see a sudden increase in bar shootings if this law passes.

8. I can carry a concealed weapon in a bank lobby.
It's pretty silly when I can do that but can't carry one into an Applebee's in Ohio.

Are suggesting that there is absolutely no possibility of danger in a bank lobby?

Have you ever heard of Willie Sutton who made a famous quote?

When asked why he robbed banks, Sutton simply replied, "Because that's where the money is."



You don't intend to rob the bank when you walk in. You are not a problem, armed or not.

If no other reason, it's far better to have your weapon with you than to leave it in your car where it might be stolen.

Sec. 2923.121. (A) No person shall possess a firearm in any room in which any person is consuming liquor in premises for which a D permit has been issued under Chapter 4303. of the Revised Code or in an open air arena for which a permit of that nature has been issued.

(B)(1) This section does not apply to any of the following:

(e) Any person who is carrying a valid license or temporary emergency license to carry a concealed handgun issued to the person under section 2923.125 or 2923.1213 of the Revised Code or a license to carry a concealed handgun that was issued to the person by another state with which the attorney general has entered into a reciprocity agreement under section 109.69 of the Revised Code and who possesses the firearm in a retail food establishment or food service operation with any class liquor permit issued for that location under Chapter 4303. of the Revised Code, or in a retail store with D-6 and D-8 permits issued for that store under sections 4303.182 and 4303.184 of the Revised Code or a D-8 permit issued for that store under section 4303.184 of the Revised Code, as long as the person is not consuming liquor or under the influence of alcohol or a drug of abuse.


(F) As used in division (B) of this section, "retail food establishment" and "food service operation" have the same meanings as in section 3717.01 of the Revised Code.


Which means this has nothing to do with bars, having Ohio fall in line with the other 38-39 states that allow concealed carry in restaurants, provided the carrier doesn't drink.

13. This bill won't change anything.
It's still illegal to be drunk/drinking while carrying a firearm.
Not everyone goes to sports bars, pool halls, or family restaraunts to get sloched... CCWers are no different.

I hate having to handle my firearm and handle it everytime I want to get lunch at Chipotle or eat out with my wife (most sit down restaraunts serve beer). Numerically, the more people have to handle thier guns the more accidental discharges there is going to be. Why make them remove the firearm when their intent is not to consume alcohol??? The current law is stupid. Personally, I think the 50% rule (or whatever TX has makes the most sense).

14.  It is the 51% law
If a retail establishment makes 51% or more of its sales as on premise alcohol consumption it receives a red license. This means that they are required to show a 51% sign at the entrance. This sign means that a legal CHL holder can not enter armed.

On the other hand, if the establishment has a blue license, and posts a 51% sign, the TABC will tell them to take it down. If they do not want CHL on premise, then they can post a 30.06 sign.

I just can't go into the bar. It's been this way for many years in Florida.

Most states have similar laws. It really has never presented a problem. No proliferation of drunken shootouts. If that had occurred, states would have changed their laws.

Here's a link to an interactive map that shows that the overwhelming majority of states that allow CCW and open carry also allow it in restaurants that serve alcohol. Even California and New York State allow it. Ohio is one of only eight states that totally ban it. Please take the time to look at the map.

Don't panic. The sky is not falling. You never want to be a Chicken Little. Don't believe everything the Brady Campaign says and don't believe everything the NRA-ILA says. Both organizations often spout bullshit.

17. That law is already here.
No guns in bars, but it is OK in restaurants that serve alcohol. But no drinking while armed. So is the guy at the next table in the Olive Garden with the ice tea the designated driver or is he the guy with the CCW?

Does not knowing the answer to that question get your knickers in a twist?

25. I am a Designated Driver. Ido not drink. As the DD, I have occasion to frequent bars with my friends
I also carry. However, when we opt for a bar instead of a restarunt, I must leave my carry weapon in my car, where it is more likely to be stolen, or always leave my carry weapon at home, for fear the group might elect to go to a bar at some point during the night.

Since some people at, in, and around bars, may behave in an irrational or violent manner, I may have NEED for that firearm.

My state laws prohibit it. I can sympathize with the people pushing this law in Ohio. Note that the law does not change the fact that it is illegal to consume alcohol in that state while in posession of a firearm.


I am an example of a person who would like to, and should be allowed to carry in a bar. You don't have to worry about be getting drunk while carrying. You don't have to worry about ANY law-abiding citizen getting drunk while carrying. Worry about the assholes carrying illegally in bars, while drinking.

Hell, our Police Chief had HIS gun stolen out of his car. A car alarm doesn't actually STOP anyone. It MIGHT scare them off. Someone MIGHT call the police. The police MIGHT get a description of the thief.

Guns don't fire themselves, so no, a gun left in your car is quite vulnerable to crime.
