Board nixes firearm ban for recreational areas in Tazewell County (Virginia)

TAZEWELL, Va. — The “no firearms” sign posted at the Cavitt’s Creek Recreation Park is coming down.

An already advertised public hearing Tuesday by the Tazewell County Board of Supervisors on a proposed ordinance that would allow citizens with a concealed weapons permit to carry a firearm in county parks and recreation areas was essential rendered void Tuesday after the board learned of an earlier adopted state ordinance.

The local ordinance was proposed by board chairman Seth White. White said his family was recently camping at the Cavitt’s Creek Recreational Area, and were surprised to see a “no firearms” sign posted.

“Anytime you see that sign, I always see that as a restriction on your Second Amendment rights,” White said.

.....However, White said County Attorney Eric Young has since learned that in 2004 the state passed a statute that does not allow counties to restrict the rights of their citizens to carry weapons. Young said after further review it was learned the state code actually prohibits counties from regulating firearms.....

.....“The point is this ordinance is unconstitutional,” Southern District board member Mike Hymes said. “So our rules up there were in violation of the Virginia state constitution.”.....



And you lot wonder why you're losing....

12. This never had a chance in Tazwell county.
Way too many gun owners...I can see Tazwell county from my back deck.
