4. Yup. As I recall, the judge wouldn't let the jury be fully instructed on NJ firearms law
because it might have led the jury to find that Mr. Aitken was in compliance with it. Erg.

8. This was the same judge.....
Governor Christie refused to reappoint Superior Court Judge James Morley based partly upon the fact that he exonerated a cop of animal cruelty charges, even though he had engaged in oral sex with calves.

6. It happens all the time.
Take for example the "stop and frisk" policy of Philadelphia.

The police stop and search people with no real reason, most are minorities, and I don't have a link for this, but have read that the numbers indicated that 1 in 6 Philadelphia residents have been so searched, mostly minorities. The real kicker is that people who then had the NERVE to complain to their betters about the treatment are often arrested for that catch-all contempt-of-cop crime...disorderly conduct.

Disorderly conduct: Just my opinion, but that shit is unconstitutionally vague.

7. I've arrested on Disorderly Conduct...
In the facts of arrest you'd better be able to clearly articulate what was so disorderly about the individual. Of course our local court system isn't rotten to the core and we are actually held up to some level of expectation that we will actually observe the rights of our citizens. In some jurisdictions, well, I've seen things that made my blood run cold.

9. I understand that there are times when disorderly conduct legitimately applies.
I also understand that it is jurisdiction specific as to what happens.

I apologize for suggesting that police in general use this as a "contempt of cop" charge. Since becoming a law student, it has just become apparent to me that in many places disorderly conduct is used as a catch-all "we-really-don't-have-anything-on-this-guy-but-would-like-to-arrest-him-anyway" charge. Whether or not a conviction can come of it is a different matter though, since simply being arrested is often enough to tarnish a reputation, even if nothing sticks.

The problem also comes from using words like "disorderly" in a legal sense. It's like "compelling government interest" as my Con-Law/Criminal procedure professor says "well, what the hell does that mean? Don't worry, the chief justice of SCOTUS doesn't know either." Some places, "I complained because I was stopped and searched for absolutely no reason" seems to be allowed. Such needs to end.

As long as you aren't arresting people that aren't actually being disruptive to society in some cognizable way...we cool.

11. Mr. Rosenberg does seem to be intent on pushing the envelope
The statement that he was following the law "to the very letter" is a bit misleading. It seems to me he was skirting the very edge of the law in order to establish exactly where the boundary between lawful and unlawful behavior lies, which is a bit further out than Hennepin County District Court and the Minneapolis PD think it is. Now, as far as I can tell, Rosenberg's legally in the right, but he's got to be awfully naive if he thought this wouldn't lead to a confrontation with the local authorities.
