Bill would cancel ban on gun used in self-defense

Arguing that a Wilmette man had a right to shoot an intruder in his home -- regardless of a local ban on handguns -- a state representative is proposing legislation that would override such bans when guns are used in self-defense.

People in Illinois should be able to defend their person and their property, said Rep. John Bradley (D-Marion), who filed the legislation this week.

"This affirmative defense would allow them to do that," he said.

Bradley said authorities are wrong in prosecuting Hale DeMar for violating Wilmette's handgun ban and for failing to renew an Illinois firearm owner's identification card. The U.S. Constitution guarantees the right to bear arms, Bradley said...

Would one be breaking the law until they used the gun for self defense? I read this article earlier and that question just kept coming to me.

3. No. Not really.
If common sense prevailed there would be no gun bans for law abiding citizens. However, this is Emperor Daleys fiefdom so you take what you can get.

4. Technically it's not Daley's, BUT
like liquid in a poor container, there is going to be seepage contaminating the surrounding area. (I could have used a cancer analogy, but I didn't want to insult the disease.)

5. It's a good start
but the best option would be to pass a law that forbids such local ordinances altogether. Not much chance of that in the state house. Look at the population distribution. Chicago/Cook County controls the state house. The Daley machine controls Chicago.

To borrow and bend a line from Jimmy Walker, "Who would want to governor of Illinois when he can be mayor of Chicago?"

6. It should be interesting...
to see whos fault this "becomes". Possibilitys include the NRA, GOP blood money, the gun industry, right wing loonies, gun nuts...etc.

I can't help but note that this IS a Democrat saying "The U.S. Constitution guarantees the right to bear arms" and "People in Illinois should be able to defend their person and their property".


Elegant proof that not everyone pro-gun is a right winger.

Now, what was it that was said about the "sort that peddles gun rights in public"?

Wow. A slur against a Democrat from the dishonest victim disarmament crowd. Who'd have thunk it.

8. Standard Pro-Gun Modus Operandi
Part of a concerted effort to get rid of all gun laws.

That guy in Wilmette must have known what the law was in his town. He chose to break that law - therefore, he was no longer a "law-abiding citizen". 'Nuff said.

10. As we've seen
the RKBA crowd would bend over backwards to celebrate if he shot at a cop and the cop shot back.

You will notice there was no law prohibiting the guy from owning a shotgun and using it in self-defense...

That's the point I've been trying to make for WEEKS here, MrBenchley!!

Those pro-gunners who paint all of us pro-control folks as "gun grabbers" fail to see that. Or like Rush Limbaugh, John Lott/Mary Rosh, Sean Hannity, Bill O'Reilly, Wayne LaPierre, Ted Nugent, and others on the right wing, they conveniently leave out any facts that blow their arguments out of the water.

12. What I find hilarious
is that faced with the website of a guy who actually does want to confiscate guns, they end up lying about those claims too.

One ought to wonder why every RKBA argument depends on denial, distortion or deception....and is made up of turds dredged out of far right wing cesspools.

Who has been howling that the problem in America is that we don't treat lawbreakers harshly enough? It surely wasn't folks from the group that's hypocritically caterwauling now about how awful anyone should even think of punishing this lawbreaker, was it? (chortle)

"Do a crime with a gun, do the time." Seems to me somebody said that here not so long ago...and I don't think it was anybody supporting gun control, as most Americans sensibly do.

Over the past few years, I've had my manhood, my patriotism, my intelligence, and even my sexual preference called into question by various people on your side of this debate. Many of them here on DU have earned tombstones for their effort.

I'm a bit concerned about those pro-gunners who have attacked me in this manner on local talk radio here in Colorado - especially those who brag on-air about having CCW permits. IMHO, a few of them sound like they should be locked up in the looney bin - not trusted with deadly weapons.
