Another frivolous anti-gun lawsuit shot down.
Just once I'd like to see a firearms manufacturer file a counter suit against these kind of asses.

October 1, 2004

"CHARLESTON, W.Va. -- A judge has ruled that the country's largest firearms maker is not liable for two police officers being shot by a felon using a gun made by the Connecticut company.

Kanawha County Circuit Judge Irene Berger on Thursday ruled that former Orange, N.J., police officers Dave Lemongello and Kenneth McGuire are not entitled to damages from Fairfield, Conn.-based Sturm, Ruger & Co., Inc.

Lemongello and McGuire had sued the gun maker and a South Charleston pawnshop two years ago, arguing they should pay damages because a Ruger handgun sold at the shop had been used to shoot them in January 2001.

Berger said it would require "a real stretch" to make the gun maker responsible for the use of a gun that had originally been sold to an Ohio wholesaler. By the time it got to the pawnshop, the gun had been sold three times and given away once..."

Yes, it's regretful that they were shot in the line of duty. And had it simply ended there then my referring them as "asses" would have been totally unjustified. But, if they want to serve as tools for the Brady Campaign and file bogus lawsuits, then their actions are fair game.
They're not going to get a pass from me because they were shot.

3. I thought "asses" refered to the ambulance chasers that took
the case. it's unfortunate in cases like this and other frivolous liability cases that the manufacturers can't sue the attorneys for re-imbursement.

4. The ambulance chasers in this case...
is the "Brady Legal Action Project".

As cops, I assume both Lemongello and McGuire are intelligent responsible adults. The Brady parasites have made them their "poster children" for <cough> "irresponsible behavior" </cough> and firearms litigation.

It's possible that initially these guys got suckered in by Brady bullshit, but as time passed and their wounds healed, they should have realized that they were being manipulated... unless that is they were looking to make a fast and easy $$$$.

5. didn't the Brady bunch just get their asses handed to them by
Bushmaster? technically they won but it cost them a fortune and Bushmaster wouldn't pay any of there costs.

You should re-read my post. Did I say they shouldn't be allowed? No, I did not. Now that we've got that out of the way, the assclowns who file such intellectually retarded lawsuits should have to pay the attorney fees of those they sue, and the assclwon attorney's representing the plaintiffs should be sanctioned for wasting the time of the court and the defendants.

The people who support these suits are morally bankrupt.

9. Sometimes asses get shot to.
Doesnt mean they deserve it though.

Nonethless, what makes them an ass is when they try to hold an innocent party responsible for the guilt of another.

11. How very odd.....
A company involved in the legal manufacture and supply of a legal product is sued for not tracking that product for its entire life-cycle and preventing it being used in crimes?

Now THAT is a stupid lawsuit......

Until the government does something that makes manufacturing firearms illegal I don't see how a suit like this could ever have any merit.

Certainly the pornshop could be sued if it turns out that they supplied the gun outside legal regulations.....or even local authorities could be sued for failing to enforce laws......But I don't see how this suit ever had merit.
