Family of dead Gaza girl demands probe of IDF shooting
http://www.haaretzdaily.com/hasen/pages/ShArt.jhtml?itemNo=530835&contrassID=1&subContrassID=5&sbSubContrassID=0&listSrc=Y

<snip>

"The parents of 13-year-old Iman al-Hamas, who was shot to death by Israel Defense Forces troops in early October, petitioned the High Court of Justice on Sunday to order an investigation of the shooting."

<snip>

"Al-Hamas' parents and the Public Committee Against Torture in Israel are asking for an investigation of whether illegal commands were given or carried out in the course of the incident. Their petition, which was filed against the top military prosecutor and the Southern Command military tribunal, also calls for Captain R. to be tried in a civilian court instead of a military one."

<snip>

"The committee says that they have extensive testimony which attests to the existence of an IDF "death zone," formed around the Philadelphi route in the southern Gaza Strip, and orders to "shoot with the intention to kill" in these areas.

"The material in this case allegedly confirms these claims," the petitioners wrote. "Orders which can mean the termination of any person in a pre-determined range are a brutal violation of the principle of distinguishing between civilians and combatants, and they constitute a breach of international military law."

1. "No soldier was charged with the girl’s death."
Parents petition Israeli High Court over daughter killed by Israeli army
Report, PCATI, 23 January 2005

"Imam Al Hams’ family and the Public Committee Against Torture in Israel (PCATI), represented by attorneys Lea Tsemel and Michael Sfard, demanded to view the classified investigation material and, after 6 weeks, Attorney Sfard was allowed to see some of it. In the petition it is stated:

“After studying the material, Attorney Sfard discerned that central, significant points were missing from the Military Investigative Police inquiry. This lead to the consolidation of our position, the result of which is this petition: the investigation of the severe incident of the killing of the girl Imam Al-Hams focused only only on finding compatibility between the lethal bullet and the soldier who fired it, and the clarification of the circumstances of the killing confirmation.

The Military Investigative Police and the Military Attorney’s Office did not examine the issue of the commanders’ responsibility for the event, nor the question of how it came about that tens of elite IDF fighters opened fire on a “figure“ who did not endanger anyone’s life (if we accept their claim that they did not distinguish that it was a 13 year old girl) and, in addition, did not first carry out the procedure for the arrest of suspects, or give the “figure” a chance to surrender or prove that she has no intention of harming anyone”.

In addition, it is claimed in the petition that the investigation material contains evidence that illegal orders were allegedly given resulting in the girl’s death. The giving and the execution of the order, according to the petition, constitute a war crime and are grounds for criminal liability for the girl’s death."

3. Moral equivalency does not apply to Israel
Israel operates inside an entire different moral universe where her actions are always righteous and justifiable.

Isn't that the same position that Al-Qaeda takes about its actions? Like Israel, Al-Qaeda also operates inside its own moral universe where its actions are always righteous and justifiable.

Isn't that also the same position the US takes about its own actions?

Don't all of them claim to be on G_d's side?

Now, if we were to hold everyone to the same legal standards, and started to prosecute and imprison people for committing crimes against humanity (which is what Israel, Al-Qaeda, and the US routinely do), then perhaps we stand a chance of imposing the rule of law over the law of the jungle.

5. Terrorism is terrorism, and it matters not to its innocent victims...
Terrorism is terrorism, and it matters not to its innocent victims that the terrorists speak Arabic, or Hebrew, or English, or Spanish.

It also doesn't matter whether the terrorists think that the Almighty is on their side, or that they are carrying out some Biblical commandment to dispossess people from their land, it is still religious extremism! So in a nutshell, there is no difference between the Hamas terrorist that kills innocent Israelis at a pizzeria from the Jewish settler terrorist that kills innocent Arabs, and Jews in some well documented cases, because they feel they are doing G_d's work.

The problem with the I/P conflict is that supporters of one side will demand justice for the crimes committed by the other side while ignoring the crimes their own side commits. Both sides are in the wrong!

8. I don't think they'll get very far...
these cases seem to disappear after a short time. Like many "investigations" concerning the self-proclaimed "most moral" army. Just a bunch of soldiers no more or less moral than anyone one else. To those that condone this action send them a pizza and avoid mirrors.
