forget about the legal merits because they don't seem to matter, do you think they'd vote for the chimp again? I think that no matter what Chimpy will lose this time. The "justices" will not ruin their legacy even more. Imagine the shame if they go in history as appointing a President not once but twice.

I say 6 to 3 in favor of Kerry (Scalia, Thomas, and one more will vote for *)....

1. there won't be vote this time
they will not vote bush in, but neither will they vote bush out.

instead, they would do what they should have done the first time, which was to stay out of it and let the constitutionally specified institutions make the call(s).

in other words, they'll let the state decide what the state wants to do, and if there's a dispute at the federal level, they'll let the house pick the president and the senate pick the vice-president.
