In a case like this, you have to fight, even at some risk. These people trying to extort this money from us will lob all kinds of charges, knowing that some in the press who don't like me or Fox News will gleefully pick the stuff up. A quick reading of O'Reilly's preemptive strike against Andrea Mackris indicates that he does not deny the truth of her allegations. Instead, he makes the following charges:

1. Makris does not claim that O'Reilly touched her or assaulted her.

- One does not have to touch an employee to sexually harrass them

2. She does not claim to have suffered any adverse employment action such as a loss in pay or demotion.

- Adverse employment action is NOT required to prove sexual harrassment. The creation of a hostile work environment is sufficient. I'm sure that most reasonable people would agree that having one's boss - especially a powerful, famous one - graphically talk about sex and diddle himself while doing so certainly fits within the definition of a hostile work environment.

3. She does not claim to have complained to FOX management.

- One does not have to complain to management in order to prove sexual harrassment, although if FOX can prove that they had no actual or constructive knowledge of the situation, they may be able to avoid liability (O'Reilly would still be on the hook, though).

The fact that O'Reilly doesn't deny the behavior, but whines that Mackris' lawyers had the temerity to make a settlement demand in advance of filing suit, is very damning.

We may be looking at the end of him.
