FauxNews gestapos fire Bull O'lielly accuser
Scandal-hit Fox News moved yesterday to fire an employee who says she was sexually harassed by Bill O'Reilly - but wants a judge to declare the canning isn't retribution.

Andrea Mackris, 33, said she was served legal papers about her termination by a man lying in wait for her at her Manhattan apartment building.

The documents said Fox had asked a judge to let the TV station dump her from a $93,200-a-year job as associate producer on "The O'Reilly Factor" - and to rule that the firing was not in retaliation for her accusations about the show's host.

his days are numbered...he has alot of enemies and they will jump on this...in the least he'll be damaged goods and not nearly the force he was yesterday.

if it gets too hot maybe fox will dump him...although i dont see that happening.

4. Judge won't do that, and FOX best be prepared for suits!
I watched some tv show yesterday where they asked 2 attorneys if the judge would do that. The response was NO.

This kind of action is wrongful dismissal at the least, and borderline bribery (if you tell I'll fire you).

Is FOX really this stupid?

10. They are that stupid. Yes. O'Liely bullies the
attorneys to do his bidding as foolish as it may be. I can just picture the big egotistical bloviating jerk stomping around the office yelling "I gonna sue, I'm gonna sue." He did the same thing when he talked the attorneys in to suing Franken over his book. He literally got laughed out of court. Once in a while, he has some lackey fox attorney on the show agreeing with his twisted view on the law.

A while back he was talking about suing M&M for using one of his own kids in a music video so he had one of the lackey, yes man, attorneys on the show to agree with his twisted logic concerning "child endangerment".

including making one of Al Franken's books a best seller via a frivilous lawsuit, no judge in this country, short of Scalia will rule in Fox' favor.

retaliation? I have seen some shit in my days as a union rep. I have seen about as much shit as anyone has, if not more. I've seen people fired for many reasons, I've read court cases and arbitration cases about people being fired. I think I know a helluva lot about hiring and firing. But I never ever dreamed of anyone being fired and served with legal papers asking a judge to declare its not retaliation. This is by far, bar absolutely none, the most ridiculous thing I have ever heard in my lifetime. I hope this girl walks away with millions from O'Really personally and many more millions from Fox. Fox guaranteed this girl to be a future millionaire. Congratulations to her, although I know this is not how she ever planned to do it.

Can you say, "CHA-CHING!" This girl just hit the jackpot.

Conservatives complain about frivolous lawsuits, yet Fox is such a huge abuser of the court system. Suing Al Franken? Come on, they shouldn't even pretend to have respect for the legal system!

And her lawyer is absolutely right that Faux is digging itself a BIGGER hole by retaliating.

A lawyer can better state this than I can, but my understanding is that the fed. law says: as long as she filed the SH charges in good faith, any action proven to be retaliatory violates the law and they will be held accountable for that.

Faux and O'Liely have already shown they have no legal expertise or judgment, in their ridiculous behavior re: Al Franken. They obviously feel that their idiot sexist audience will stick with them no matter what, and more idiot sexists may join them, if they keep this in the news.

According to the Ellerth case they have a defense if they can show (a lawyer can correct me please):

1) there were no negative tangible consequences to the accuser from the SH (that might have been the case before their retal.) AND
2) they effectively prevented and stopped other SH (maybe they had done this in other cases, though I doubt it--but they probably had a written policy since nearly every org does, which helps them) AND
3) HERE's where they really have handed her the case: they can show that she UNREASONABLY failed to use the existing complaint channels or notify someone. Hmm, this one might have been tough for her to show--that it is unreasonable for them to have expected her to report it because they wouldn't have corrected the problem, would have humiliated her, etc. Even if every allegation were true, if the court said she should have reported it, she loses. But now, the fact that they filed a suit in retaliation for her complaining about harassment works in her favor. She may argue that there were indications that people knew they had better not complain or they'd be fired, which is pretty damn reasonable if she has evidence that other people also were harasssed with no correction and/or with threats (which she said in her complaint that she did) AND that once she did complain, here was a retaliatory lawsuit and threatened firing. Would a reasonable person be expected to believe that the company would have corrected the problem had she reported it to them?
