If Kerry wins EV and loses PV, I betcha the EC will be banned in a flash! |

Imagine if Kerry were to win the Electoral Vote and lose the popular vote. I bet Republicans will pour into the streets and riot over the "illegitimate" president-elect who lost the popular vote, and then the Republican congress and states will ram through a constitutional amendment to abolish the Electoral College.
And I also bet the news media won't even notice the irony.

1. If Kerry wins the popular vote |
|
and loses the Electoral vote because of things like Florida in 2000, I think the time will have come to call for national strikes across the nation, and mass demonstations in D.C.

2. bushco was prepared to argue that in 2000 |
|
expecting that they might take the pv and lose the ev they had prepared arguments and a public campaign to try to take the presidency.
bush respects no law and has no morality.

11. This might explain why the SCOTUS ruled "without" setting precedent... |
|
in Gore v. Bush.
If Kerry does win the EC and Bush the PV, then the court would not have to consider the "precedent" set in the 2000 ruling that gave the White House to Bush. It can give Bush the White House again in 2004 even when the circumstances are reversed...

3. actually the repugs will go to the supreme court |
|
to rule the electoral college unconstitutional
This is what they were planning to do in 2000 but the reverse occurred

The electoral college has disadvantaged Democrats for a long time. There would be nothing better than a bipartisan effort to get rid of it for future elections.

5. Can't "ram" it through the states |
|
Passing a constitutional amendment simply can't be done quickly - 2/3 of each house of congress and 3/4 of the states would need to do it - that takes time. I don't see all the small states agreeing to give it up. The Republicans couldn't even pass an amendment to let Reagan run for a 3rd term.
This isn't even a remote possibility.

6. But these are Republicans we're dealing with |
|
I know the small states wouldn't ordinarily want to give up the disproportionate power they have in the EC, but since when were Republicans rational? I bet a lot of the Republican small states would be consumed with rage over a Kerry PV-loss/EV-win and would go along with the effort to abolish the EC.

12. remember the 18th amendment? |
|
AKA prohibition? Proposed to state legislatures in December 1917, ratification complete January 1919 - a little over a year, and all this before extensive radio (not to mention television and internet) campaigning. So don't bet on it. (Congress would be the sticking point, I think). I'd like to see it happen, though: then those of us in "safe" states may actually get to see a presidential candidate for a change.
Personally, I expect Kerry to get the popular vote, and the electoral vote will be decided by courts in a few states.

... for exactly this recult. The EC is an obsolete anachronism that distorts the entire electoral process needlessly.
While we're at it I'd love to revamp the Primary system.
I am sick and tired of a handful of states deciding the entire outcome of our elections.

8. On second thought, I bet this would happen.... |
|
The Rs would probably launch an effort to have the blue states apportion their electoral votes in future elections and then fight any effort to do the same in red states... the same Rethug hypocrisy we saw in DeLay's Texas gerrymandering and the recall in California... anything to maintain power... anything.
