If I had the money for it, and if my candidate lost,
and if my state used different types of voting machines in different counties, I would immediately file suit that my equal protection rights guaranteed under the Fourteenth Amendment had been violated.

How could this Supreme Court seriously rule against me, in light of their 2000 ruling that RECOUNTING votes under different standards was an equal rights violation? Counting votes under different mechanical methods GUARANTEES that some people in some counties will be statistically valued less than others.

I'd sue to have the entire election tossed.

1. They wrote an out into that decision
They specifically stated Bush v Gore could not be used as precedence in any other case.

2. That's just what the GOP plans to do!
They are going to be using the unreliability of the BBV machines to contest the election.

3. I fear you're correct.
I wonder...

When Kerry appoints another Supreme Court justice, can a new set of justices go back, without a suit brought before them, and disavow certain decisions that displease them?

I believe it's almost universally recognized that Bush v. Gore was an asinine and partisan decision.
