Without a waiver from Congress, Clark cannot be appointed Secretary of Defense.

§ 113. Secretary of Defense

(a) There is a Secretary of Defense, who is the head of the Department of Defense, appointed from civilian life by the President, by and with the advice and consent of the Senate. A person may not be appointed as Secretary of Defense within 10 years after relief from active duty as a commissioned officer of a regular component of an armed force.

Clark, having retired in 2000, is not eligible. Only once in the history of this position's existance has Congress issued the needed waiver. Granted, that was during wartime, a time as similar as now; however, politics wasn't as contentiously polarized when it waived that rule for George C. Marshall, Harry Truman's third Defense Secretary.


Besides, I think Clark would make one OUTSTANDING SoS!

I love Al Gore, but I don't see him in that position, at all.

John Quincy Adams served with distinction in the House of Representatives after leaving the White House; and Andrew Johnson was elected to the Senate.

24. Clinton isn't eligible either
The Presidential Succession Act of 1947 places the SoS fourth in line for the Presidency should something happen to the President. As Clinton served eight years as President, and is only allowed ten years during his lifetime by the Constitution (22nd Amendment to be exact).

If something were to happen during the first half of the Kerry presidency to pass the presidency to Clinton, this country would be in a lot of legal trouble.

31. I don't think that disqualifies him
from being SoS, only means he is skipped in succession. I think this applied to Kissinger who was SoS, but not eligible for succession since he was not a native citizen.

person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President when this Article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term."

In the unlikely event, Clinton would succeed, not be elected. He would therefore not be able to be re-elected, but he could serve.

It is constitutionally unambiguous.

45. This has never been tested.
And the Supreme Court has managed to mangle the Constitution before; Bush v. Gore, Schenck v. U.S., and Korematsu v. U.S. are all good examples, even if it is "constitutionally unambiguous."

I do not want to see this tested either, because the freepers will turn it into a Second Civil War. Nevertheless, I stand corrected on a technicality.:)
