A pardon can only be issued if a person has been indicted for a crime and has begun serving the sentence. To date, there have been very few (if any) people who have been indicted, largely because the GOP has controlled both houses. This means, irony of ironies, that there is in fact no legal protection that any of this administration's many criminals can seek once out of office. I suspect this is a big part of the reason why there is such a sense of panic coming out of the White House right now. While it is unlikely that President Kerry would in fact let Bush be tried at the Hague with War Crimes (it sets a very bad precedent) my suspicion is that a turnover of the Senate would result in there being a strong push on the part of the G7 for the US to try Bush.
