And Bush has a second term.
Now an Elector could switch (Bush to Kerry) and break the tie.

Just the fact that one of the canfdidates does not get a majority throws it to the House and the Senate.
As long as Kerry does not get more than 269 electoral votes, Bush wins regardless of how many electoral votes he gets.

Kerry MUST GET MORE THAN 269 ELECTORAL VOTES TO WIN!
Whether in court or via any other shenanigans, regardless of how many electoral votes Bush gets, so long as Kerry has no more than 269 electoral votes on January 6, 2005, Bush wins so long as he is one of the two candidates with the most electoral votes.

Bush will win, even if he has less than 200 electoral votes on January 6, 2005.
That's the constitution and U.S. code. There's no way to get around that simple fact. John Kerry MUST have 270 or more electoral votes to win. Anything fewer than that, and Bush wins.
