Olson: Bush can make recess appointment to replace Rehnquist
Newsday has a story coming up that quotes Ted Olson, former solicitor general and Bush's lawyer during the recount coup d'etat in 2000, arguing that Bush can just make a recess appointment if Rehnquist steps down.

A recess appointment does not require Senate approval, although the Senate can reverse it later. But if the Senate remains Republican, that's not likely to happen.

5. they are, and I'm pretty sure that they don't have to be rescinded, BUT
they must be duly renominated, and subject to the INEVITABLE filibuster, as will the ones he sneaked through earlier

somebody will corroborate this soon, I'll bet

6. If the appoinment is not passed by a Senate vote
the recess appointment would be in effect until January 6, 2006.

8. that's what I read here before, but why is it not allowed only until the
very next session of congress convenes, instead of giving him an entire YEAR of these douchebags for "strict" construction

Article II.

Section 2.


Clause 3: The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

right?

if he does it after the lame duck session, following this election, during which they could have overturned the impeachment vote in congress, right?

so, if he waits til after they go home, he'd get two years, but if he does it during the lame duck session, it would only be til this January?

15. If he appoints while the Senate is in recess during December
the appointment stays in effect until the end of the next session of the Senate.

The next seesion of the Senate begins on January 6, 2005. It ends with the beginning of the session after that. That session begins on January 6, 2006.

In fact, that's when all of Bush's recess appointments end as he only started in making them during this session of the Senate.

I don't think Bush is brave enough to take the flak for a two year appointment.

The senate would be forced to change the rules on filibusters which would be VERY nasty. It would be unprecedented and an obvious power grab.
