2. At LEAST
she had the honor not to retire during Chimpy's reign of terror.

She'll never be forgiven for Bush v. Gore. But at least she didn't retire.

6. And she surely wanted to
But she knew how it would "look". I read an article which said she was truly shocked at how people viewed their decision. Good, let it and Iraq haunt her golf games for all time.

18. How it would "look"?
She's not a movie star - she wouldn't care about perception, she's set for life speaking, writing, lecturing, etc. She doesn't need a good public image when she retires, and I would hope that the last thing on a Supreme Court justice's mind is how something would "look" - that's why they have life terms.

I seriously think it has more to do about how she would be replaced than how it would "look" if she retired during Bu$h's term.

12. Heh.
I hope you're kidding, but if not, welcome out from under your rock! The original poster is referring to the debacle in 2000, where the SCOTUS judged for Shrub&co.

7. Temperamentally She's A Great Judge...
If I had to choose to have nine Sandra Day O'Connors or leave it up to a Puke Pres to replace her I'd take nine Sandra Day O'Connors...

Sandra Day O'Connor

right on gay rights

right on choice

right on affirmative action...

11. I agree
She's been moderate/left on a lot of issues. Perhaps she was mislead in 2000, perhaps she was just badly wrong. But she's done a pretty good job in my eyes over her career.

I think of it this way: Would I like her vote in 2000 to be switched if it meant all of her votes would be switched? I don't know, it'd be close - she's been the tie-breaker for the left on some pretty big decisions that have come up. So I can't condemn her just on one vote.

8. I think she grew a conscience a couple of years later
I heard she didn't know how Bush was really like.

I also heard she didn't like Gore personally, but I don't know how she feels about Kerry.

I wrote her a nasty letter after her nefarious vote. She'll never redeem herself in my eyes.

10. She's not that bad
She's cast a lot of tie-breaking moderate votes to keep the conservatives at bay, and she had the sense not to retire during the last four years (remember all the talk in 2000 about her hoping Bush would win because she wanted to retire?). The 2000 decision was reprehensible, but I think on whole she's been a pretty good justice.

14. She held the center for quite some time. But that one big screw-up
tarnished her reputation. And yes, at least she didn't retire, but then, none of them did. Look at poor Rehnquist, he might have, except for pride. I think Sandy Day realized they had gone beyond the pale.

17. I think the fact that none retired speaks volumes
No matter what you think of the 2000 vote, she and Rehnquist could have retired when it was "safe" to do so (with a GOP congress and President), and they didn't. I think that says a lot about what they think of Bush.

28. I wondered about that, too. I'm shocked that none retired and think...
they must have realized they'd rather have a dem appoint someone rather than leaving it up to such a moron.

Clinton's picks have been fine. I wish they were younger but I prefer more moderate judges. That might have been the reason Renq. and Sandy stayed on. You gotta think 1-3 judges will be gone in the next 4 years.

15. Frankly I think she stayed on hoping Bush would be defeated.
It was thought before 2000 that she would be retiring. There had to be a reason she didn't leave during the Shrub's 4 years when he definitely would have appointed an ultra conservative justice.

19. Should this thing go to the courts again (and I don't think it will.....)
...I believe O'Connor and Kennedy would be on our side. I have heard that they regret their involvement in the Coup. And with Billy Rehnquist on sick leave, that would leave Fat Tony and Clarabelle standing alone.

23. If Rhenquist is unable to participate
...either due to serious illness or untimely demise, AND the split is 4-4, then the lower court ruling, what ever it might be, would stand, and no precedent would be set.

But it ain't a-gonna come to that. If you know anyone who may have not voted, give them a ring, ask them if they need a ride to the polls. If we get our people out, we win.

On an unrelated note--I'm seeing a clip of JK and Teresa on the TV--Teresa looks especially fabulous in that smart green outfit. JK and T went to UNION OYSTER HOUSE for lunch, JK enjoyed a dark beer with his meal (weecowboy is probably consumed with jealousy, as he fishes out the bottle of Jim Beam he has hidden in the toilet's holding tank....!).

WOW--a President who can TOAST people with alcohol. Wine with dinner at the White House! Perhaps there will be STATE DINNERS again, with entertainment, that don't end at 9 PM!!! Arts, CULTURE, sophistication!!! Out with the big belt buckles and cowboy boots, IN WITH THE SYMPHONY and JAZZ! Yee, friken, HAW!

will haunt the annals of history and make that decision to be one of America's worst moments! And the best is * will always be an * thanks to SCOTUS!
