Hey, stupid Ohio question....
Watching CNN the other night, during the whole "too close to call" thing during the election, they said that under Ohio law any candidate could force a recount....

...or any group of five citizens could force a recount.

Is this true? Anyone here familiar with Ohio law who could look it up?

If it is true, we need five Ohio DU'ers to step forward now!

Everyone screams about how we were robbed, but no one wants to research it? Or stand up for it if they have standing?

I looked it up, and apparently the five voters rule only applies to questions. However, something interesting in the law:

§ 3515.01 Persons eligible to apply for recount

Any person who was a candidate at a general, special, or primary election for election to an office or position who was not declared elected may file with the board of a county a written application for a recount of the votes cast at such election in any precinct in such county for all candidates for election to such office or position.


In other words, if I'm not mistaken, the way the electoral system works for the Presidency, any declared Kerry/Edwards ELECTORS could apply for the recount, and get it. All we need is to convince one person nominated to be an elector for the Democrats to file the paperwork. He or she could even do it without the consent of Kerry.

Worth pursuing?
