STATEMENT OF FCC CHAIRMAN MICHAEL K. POWELL
In response to recent reports regarding potential violations of the "payola" and sponsorship identification provisions of the Communications Act, I have instructed the Enforcement Bureau to open two investigations:
One into issues regarding commentator Armstrong Williams; and the other into issues regarding station WKSE (FM), Niagara Falls, New York, licensed to a subsidiary of Entercom Communications Corporation.
These provisions govern disclosure and sponsorship identification regarding payments or
other consideration in connection with broadcast programs.

2. yeah, the investigations these guys open up

go nowhere fast.

You hear alot about the Plame investigation, or the missing explosives investigation, or the billions missing from the pentagon investigation, or the haliburton scam investigation. The list of 'investigations' goes on and on, but you don't ever hear about anything ever actually transpiring because of them.

Any on-air push he had given to the bill, Mr. Williams said, was voluntary, stemming from his conservative outlook. He also denied breaking any journalistic code of ethics.

"I'm not a journalist; I'm a pundit," Mr. Armstrong said.

Mr. Powell, in a brief statement announcing the investigations, said they were aimed at "potential violations of the 'payola' and sponsorship identification provisions of the Communications Act."

Agency officials said the offense could cost Mr. Williams and, potentially, the local broadcasters who ran his show up to $11,000 in fines. Under agency regulations, individual broadcasters are required to disclose any payments from outside entities in exchange for promoting items on-air; local stations are also expected to disclose those payments if they are aware of them.
