So why isn't Novak and Rove in Jail? |

Now we have confirmation that Karl Rove is obviously innocent because it was Mr. Novak who gave him Mrs. Plame's name. Now, why isn't Mr. Novak in jail or subpoenaed to testify before the grand jury? There was a crime committed, Mr. Novak knows who perpetrated the crime and that was just confirmed by Karl Rove. If I were an attorney for Judith Miller, I would be going ape-shit at the judge right now. What makes Mr. Novak so special he isn't subject to the same treatment as Mrs. Miller?
Now, of course, if Mr. Novak would also like to confirm this statement by Mr. Rove, I believe we can simply call off the dogs and he can return to business as usual. Oh, but of course there is that little issue of his confirming the story about Mrs. Plame and her role in the CIA. Up until the time she was outed, she still had the protection of the law and your comment should have been "No comment" and not, "and you heard that too!."
I believe this may need some further inquiry. Simply because you didn't name her first does not exonerrate you. She was still protected by the law. You confirmed to a commentator the identity of a CIA agent. I bet if John Conyers had confirmed the name of a CIA agent who was then subsequently outed, he would have some serious questions to answer. I think you should too.

He must have. Unless he refused to name his source, as Miller did, they have no basis for prosecuting him. The law that covers Rove does not apply to reporters or others without national security clearance.

he spilled the whole enchilada. Now if YOU were Fitzgerald, would you endanger your case by arresting Novak and alerting the rest of the perps that you know that they know? I wouldn't. Novak isn't going anyplace and isn't the type to flee the country, and if he attempted to, Fitz probably has him under surveilance to keep him home. By Novak running loose, that gives Fitz time to garner evidence and testimony against one and all.
All the perps are aware they are in the spotlight, and are keeping quiet hoping upon hope they'll be missed...all except Rovie boy..the beans were spilled on him with Cooper's notes, so he has to wind up the mighty Wurlitzer and let the spin and misinformation be slung far and wide, so people will think he's clean as the driven snow. We all have to wait and find out what Fitz has because his are the words that count, and it must be quite a mouthful he'll have to have the judges involved agree that the journalists were jail bait for not testifying.
