Is the image of the President considered copyrighted material?

Is the image of the President considered copyrighted material?
That is to say, if I wanted to put his likeness on a piece of material such as say, a jacket or a hat or, for arguement's sake, toilet paper, would I need to seek his permission or is his likeness now considered public domain, so to speak?

I was thinking of coming out with a line of toilet paper that held the likeness of Dubya, Cheny, Rove and the rest of the GOP shitheads. Do you think I could get in trouble? Also, I didn't leave Republicans out of my marketing strategy, I planned on putting the Constitution on thier rolls.

3. Depends on the photograph
If you take an AP photo, their photographer could rightly claim it.

I'd stick to something from defenselink, if you can find a suitable image, since those ones are explicitly in the public domain unless otherwise stated. (or another site with the same sort of usage statement)
