we're technically not at war, that's just PR talk. The Congress would need to declare war, they just gave Bush authority to attack Iraq.....if Saddam didn't get rid of his WMD. :evilgrin:

The Constitution of the United States defines only one crime, treason. Article 3, section 3:
Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.
Somehow, I think any of that would assume active collaboration with the enemy. As far as I know, neither Rove nor Libby has had any meetings with Osama or any of his agents since September 11.
More likely charges involve violations of the Espionage Act, perjury, obstruction of justice and conspiracy.
If convicted and not pardoned, that will put them both behind bars where they belong for a long time.
