How the Dems should handle the document request |

It seems the White House is willing to provide documents from Roberts' stint in the Office of White House Counsel, but isn't willint to provide any documents from his stint as Deputy Solicitor General.
I think the question that has to be raised, and in a very public fashion, is whether anyone in the White House who vetted the process had access to his work product as Deputy Solicitor General or discussed this material with Roberts or people who had worked with him.
After all, it's only fair that Democrats on the committee have access to the same material that the White House used in its vetting process.

I don't think * can make a recess appointment of a Justice, could be wrong on that.

Earl Warren was a recess appointment. He was later confirmed by the Senate.
