article regarding the imposition of martial law from 2000
Given the number of concerns regarding hints of potential upcoming usurpation of power by the declaration of martial law (e.g. General Tommy Franks' Cigar Aficionado interview, and various commentators' statements about the imposition of martial law in the wake of a real or feigned terrorist attack), I thought it prudent to look for some kind of web reference about what kinds of restrictions may exist on the imposition of martial law. I myself struck out, but I do have a friend who is a lawyer, and he turned up an essay he described as a "good starting point."

Someone less preoccupied by their job may find useful information in there about the various conditions on the imposition of martial law. My own interpretation is that this area of the law has loopholes so vast you could float aircraft carriers through them, and I didn't find anything resembling procedures or anything like effective regulation of it. Apart from that I'll keep quiet about the usual fears and just point at the article.

The essay is "The Imposition of Martial Law in the United States," by Kirk L. Davies. It appeared in Air Force Law Review in Spring 2000.
