SNIP

McCallum is on good personal terms with both Bush and Cheney, and is a true believe in the imperial presidency.

SNIP

First, he is a Yale classmate of one George W. Bush. (As as commenter Lysias noted, a Skull and Bones classmate of Bush, to boot.)

Second, he is the member of Attorney General John Ashcroft’s senior staff who Ted Olson and the White House specifically asked to defend the Administration in the Cheney Energy Task Force/Enron legal proceedings.

Third, he was in charge of the early stages of the Valerie Plame investigation before even Ashcroft concluded that an outside counsel was needed. He was also the lead attorney in defending the government’s right to prevent news organizations from finding out about terror suspects detained by the US.

SNIP . . . . .

16. Before he was up for SCOTUS
Robert Bork was most famous for being the guy who Nixon finally got to fire Archibald Cox in the Saturday Night massacre.

http://en.wikipedia.org/wiki/Saturday_Night_Massacre

It reminds me of the Archibald Cox incident, in the same
Henry II "Who will rid me of this meddlesome prosecutor" sort of way.

So it looks like ** has found his BORK BORK BORK BORK BORK!

I think this time, just like last time, the presidents Bork is worse than his bite.

TREASONGATE: The US Attorney General's Office AND President Bush Have NO LEGAL AUTHORITY To Remove Patrick Fitzgerald As Special Counsel
The Attorney General, Acting Attorney General or any other officer of the Department of Justice has NO LEGAL AUTHORITY to remove Special Counsel Fitzgerald from the Treasongate investigation or prosecution-- AND -- President Bush does NOT have the legal authority to fire Patrick Fitzgerald in his capacity as "Special Counsel".

Analysis of federal law (involved with both the appointment of -- and authority granted to -- Special Counsel Fitzgerald), Comey's press conference of December 30th, 2003, and Decision B-302582 (September 30, 2004) issued by the Government Accounting Office, leads to the following legal conclusions:

1. James Comey, in his capacity as Acting Attorney General, with respect to the Justice Department's investigation into "the alleged unauthorized disclosure of a CIA employee's identity" (hereinafter "Treasongate"), delegated his plenary authority to Special Prosecutor Patrick Fitzgerald, pursuant to 28 U.S.C. 508, 509, 510, and 515, conferring upon him "all of the authority of the Attorney General" thereby transferring his status as Acting Attorney General, in this matter, to Fitzgerald."

17. Wrong> Bush's Old Skull and Bones Bro May Oversee Plame CIA Leak
With Attorney General Alberto Gonzales recused, department officials say they are still trying to resolve whom Fitzgerald will now report to. Associate Attorney General Robert McCallum is "likely" to be named as acting deputy A.G., a DOJ official who asked not to be identified because of the sensitivity of the matter tells NEWSWEEK.

But McCallum may be seen as having his own conflicts: he is an old friend of President Bush's and a member of his Skull and Bones class at Yale. One question: how much authority Comey's successor will have over Fitzgerald.

When Comey appointed Fitzgerald in 2003, the deputy granted him extraordinary powers to act however he saw fit—but noted he still had the right to revoke Fitzgerald's authority.

31. CS speaks
so you have a disagreement with CS

"WHY CAN'T FITZGERALD BE FIRED AS SPECIAL COUNSEL?

First, let me make it clear that Patrick Fitzgerald, while wearing the hat of US Attorney for the Northern District of Illinois, can indeed be fired or replaced by President Bush. There's no doubt about that.

But Fitzgerald wears a different hat pertaining to Treasongate where he is the "Special Counsel" "Acting" and vested with the "full authority" of the "US Attorney General" to prosecute Treasongate. And as such, nobody in the Department of Justice can touch him.'"

I am not attorney but have some experince with legal system..and there are lots of laws to complicate any case BUT this law if CS is correct in his interpretation is specific..

18. Thanx dbeach !!
:toast:
3. While President Bush may fire or replace Fitzgerald as the "US Attorney for the Northern District of Illinois", the President has NO AUTHORITY to fire him as the "Special Counsel" in the Treasongate investigation.

Fitzgerald wears the following two hats:

1. US Attorney for the Northern District of Illinois.

2. Special Counsel in the Treasongate investigation "Acting" with the full authority of the US Attorney General.

so even if this is what you think

""Speculation is running rampant as to whether Patrick Fitzgerald and his grand jury investigation will be shut down by Bush administration operatives. You may believe that Bush cannot risk the political fallout associated with removing Fitzgerald, but his team of fascist criminals will shoot first and ask questions...never."

it's beside the point becuase according to the law Fitz can not be removed from the case.

Bush for Life: GOP introduces new bill to Congress

author: Colorado Palestine Solidarity Campaign

Republicans have officially started the the campaign to amend the Constitution by repealing the 22nd Amendment - the one that confines the President to two terms.

If the Republicans hold their current strength, or increase it, in the 2006 Congressional elections, expect this measure to pass allowing Bush to remain President...

Proposing an amendment to the Constitution of the United States to repeal the 22nd amendment to the Constitution.

IN THE HOUSE OF REPRESENTATIVES

February 17, 2005

Mr. HOYER (for himself, Mr. BERMAN, Mr. SENSENBRENNER, Mr. SABO,
and Mr. PALLONE) introduced the following joint resolution; which was referred to the Committee on the Judiciary....{More on Indymedia}

~~~~~~~~~~~
Sounds like Dick Cheney's plot to be president for life. Once the 22nd amendment is repealed look for President Smirk to be liquidated. Perhaps the elites who installed President Smirk are getting tired of his botched job of invading Iraq and not going on schedule for Iran. Then again it could just be that he couldn't pull off the Social Security "Bank Robbery" for his Wall Street Mafia bosses. They have trust in Cheney, though. He's never shirked in his duties as a full-fledged sociopath. When it comes to wanton murder, rape and pillaging he is right up there with his mentor Sir Heinz Kissinger.
~~~~~~~~~~

The sponsor of the bill is a Democrat, 3 of 4 of the co-sponsors are Democrats.

Believe me, I wanted to believe it was Republicans, myself.

Rep Steny Hoyer(D) MD, the House Democratic Whip, is the sponsor of the bill.

These are the co-sponsors:

Rep Berman, Howard L. (D) - 2/17/2005 Rep Pallone, Frank, Jr. (D) - 2/17/2005 Rep Sabo, Martin Olav (D) - 2/17/2005 Rep Sensenbrenner, F. James, Jr. (R) - 2/17/2005

Watergate! -- Nixon ordered the special prosecutor to be fired, (Cox)so it shouldn't come as a surprise that Fitz will have serious problems doing his investigation?? --

these people can pull off a phoney invasion to go to war, kill well over 100,000 people, handling Fitgerald should be cake! - then again, Fitzgerald may not be able to handle all the s-t-r-e-s-s and end up committing suicide, or....something.

11. I Hope the Federal Agents Spoken About in This Article Arrest Bush if he
tries to stop the Grand Jury investigation by intimidating Patrick Fitzgerald. The Truth Seeker is a very good site.

Bush Plans to Fire Prosecuter
by Tom Flocco – August 7, 2005 TomFlocco.com

Update

Despite initial scepticism we posted the following. Now it appears that the following story has mutated once again with its appearance in Newsweek, as claimed. However Fitzgerald will not replaced by Robert McCallum, who is appointed as Fitzgerald supervisor from which position may be able to help out his old Skull & Bones buddy. Ed.

Sunday morning online editions of Newsweek and Time are reporting that the President is planning to fire Chicago's U.S. Federal Prosecutor Patrick Fitzgerald and replace him with a Bush classmate/Skull and Bonesman from Yale.

Following on the heels of these reports, we have learned from U.S. intelligence sources that federal agents are prepared to immediately arrest Mr. Bush if he fires Fitzgerald and seeks to obstruct justice and commit additional treasonous acts regarding ongoing grand jury proceedings against his administration and himself.

Fitzgerald

TomFlocco.com reported last week that Fitzgerald's grand jury voted out perjury and obstruction of justice "True Bills" or federal criminal indictments against President Bush, Vice-President Cheney, Attorney General Alberto Gonzalez, former Attorney General John Ashcroft, former CIA Director George Tenet, Presidential Senior Advisor Karl Rove, Presidential Chief of Staff Andrew Card, Vice-Presidential Chief of Staff I. "Scooter" Libby, imprisoned New York Times reporter Judith Miller and Vice-Presidential Senior Advisor Mary Matalin.

On Friday, federal whistleblower Tom Heneghen reported that the true bills also listed Supreme Court Chief Justice William Rehnquist and Justice Antonin Scalia as unindicted co-conspirators.

According to sources close to the grand jury, Fitzgerald's citizen panel is now able to prove that George W. Bush was not legitimately elected president in the 2000 election; but more importantly, it has fingered the United States Supreme Court for fraud, obstruction of justice and treason, making the Bush terms totally illegal.

The scope of the indictments and investigations indicates that the grand jury's indicted criminal acts reaching back to 2000 will lead to further legitimate assumptions that Bush-Cheney involvement in the 9.11 attacks and sending American young people to war based upon lies orchestrated by Mr. Bush and British Prime Minister Tony Blair are both squarely in the sights of the grand jury.

Washington -- August 7, 2005 -- TomFlocco.com -- Sunday morning online editions of Newsweek and Time are reporting that the President is planning to fire Chicago's U.S. Federal Prosecutor Patrick Fitzgerald and replace him with a Bush classmate/Skull and Bonesman from Yale.
http://www.tomflocco.com/

You need not try to click the Flocco link above, it does not work. He took his website down because of the faux pa. His inaccuracy was blamed on the website administrator.

Guess we better hope he is not right about everything, unless of coarse you do not like Clinton...

Besides the Valerie Plame CIA leak case, the Fitzgerald probe is reportedly far-reaching and expanding much deeper into past White House criminal acts involving Bush-Clinton drug money laundering in Mena, Arkansas to White House involvement in 9.11; http://www.thetruthseeker.co.uk/article.asp?id=3421

Even Tom Flocco's own accounts, Grand Juries have been rigged....

Bless the Beasts and the Children
Photographer for White House child sex ring arrested after Thompson suicide

Tom Flocco | March 13, 2005

The Justice Department, acting through the FBI and the U.S. Attorney’s Office in Omaha, emerges from the record of the Franklin investigations not so much as a party to the cover-up, but as its coordinator. Rigging grand juries, harassment of witnesses, incitement to perjury and tampering with evidence--federal personnel were seen to apply all of those techniques in the Franklin case. (John W. DeCamp, Esq., The Franklin Cover-up , Second Edition, January 2005)

Just saying, I would not start salivating over an unconfirmed online article posted on the web.

Are Josh Marshall's TECHTONIC PLATES finally starting to move?

A few points before signing off, though. You may have noticed a slight down-tick in the frequency of posts of late. And that’s for a few different reasons. But a principal one is that I and several colleagues have been working on a story that, if and when it comes to fruition — and I’m confident it shall — should shuffle the tectonic plates under that capital city where I normally hang my hat. So that’s something to look forward to in the not too distant future. And that’s taken some of my time away from TPM and prevented me from sharing with you some delectable tidbits which otherwise I would have loved to have done.

45. Not my style..
my uncles fought against the nazis and fascist in WW II and I served in VN and have many Vets in my family and for friends..The thought of actual nazis is chilling..scary that they hide in the open..Do ya eevr read the Buchanan article about prescott bush?..he studied it at the natl arhives in MD ..Very interesting..also " American Dynasty " by Kev Philips shows alot of insights into the bushies and their quest for power..

nothing is conclusive about family bush but buyer beware

PEACE!

38. What will you feel? outraged? if Fitzgerald is "removed"
Bush lied to go to war - getting rid of Fitzgerald would be a cake walk,
Our Democratic leaders run their mouths off with little results as some of you may have noticed??!!

40. bush can not fire him and he'd have to do something about McNulty also
This all tied together

Paul J. McNulty, US Attorney, Alexandria office.

McNulty was one of the lead US attorneys in Operation Ill Wind, the massive DoD procurement scandal that ran for years during and after the Reagan administration. Very thorough, and rather tenacious. Not a good sign for others in the Bush administration.

'In the midst of aggressively pursuing corruption at the state and local level in Chicago, U.S. Attorney Patrick Fitzgerald is facing an immense challenge in his apparently unprecedented dual role as special prosecutor in the White House leak investigation.
In Chicago, his workload includes the prosecution of former Illinois Gov. George Ryan and an investigation of corruption at City Hall. In Washington, he's investigating the leak of CIA agent Valerie Plame's identity to the press, a probe that appears headed toward presidential adviser Karl Rove."
