Bush should elevate OConner to Chief Justice
She would almost certainly accept if offered, and the Senate would confirm without argument.

This would pave the way for an easy confirmation of Roberts, so the WH can get their man, plus it offers the left the first woman Chief Justice.

The balance of the court remains essentially the same, and Bush can claim a historic moment. It also avoids a nasty fight at a time when the nation probably doesn't need it.

3. It would be nice to have a female Chief Justice.
Would Bush pick her though?

5. Wasn't it already announced
that * would put Roberts in as C.J.?

Further demonstrating for anyone who gives a shit about how things ought to work, that * is totally out to lunch, because Roberts has very little experience as a judge (around 2 years) and there are those on the SC now who should get it instead just based on that. Of course * can't appoint any of the libs; I guess that leaves Scalia and Thomas. Either of which would be horrible but would make more sense from a management (and fairness) point of view.

4. O'Connor husband has Alzheimer's
She resigning to take care of him before whatever is left of his life ends.

So I don't think she would accept if offered. Would you???
