Word on the Hill Re: DeLay indictment - "it's already been dismissed"

I've got some sources on the Hill that hear the indictment's already been dismissed. They're higher level guys from the Republican side, so I don't know whether or not there's any truth to it, but that's the word I'm hearing. Don't shoot the messenger.

It just wouldn't make any sense, but it comes from a guy that previously said DeLay should be stepping down anyway. I'm just passing along the info though, for whatever it's worth.

4. How does that work, legally speaking?

I was on a grand jury once. I assumed that when we voted to indict on a prticuar charge that the case had to go to be prosecuted in a court of law.

Perhaps the judge assigned to the case already gave the order to dismiss the charges based on what he/she perceives as a lack of evidence. I don't know at all. Like I said, I'm just passing along the info.

The indictment doesn't just go away, but the case would be dismissed. One way or another, even if he was just indicted for a second, he'd be forced to give up leadership.

Again - I wouldn't even bother passing the info along if it didn't come from someone I'd believe. It doesn't sound right to me either.

His stepping down, however, is forced the moment the indictment happened if the GOP is to follow their own rules at all.
