Hannity just had delay's lawyer on and said the indictments are wrong and that what he did wasn't a crime when he did it!

if any prosecutor would make such a stupid mistake, so I'm assuming it's not true.
The Constitution clearly forbids ex post facto laws in Article 1, Section 8-3.
For anyone who doesn't know, an ex post facto law would be like a cop giving you a speeding ticket for going 39 in a 30 mile per hour zone, but the sign wasn't reduced to 30 mph until two days after you got the ticket. When you got the ticket, it was a 40 mph zone. That's clearly illegal, and every prosecutor would know that so I don't think anyone would make a mistake like that on such an important case.

especially when you are looking at facts that happened years ago. That isn't something that we (I'm a prosecutor) normally think about. We look at the 2005 criminal code, we look at the facts of the case and see if they violate one of the crimes. Something like the law changed in 2003 and the crime happened in 2002 could slip past. That is what is claimed to have happened here. He was looking into crimes that happened several years ago, and the law was changed the next year (also several years ago).

I've heard rumors of that too. The Tx. law was changed a year leter. I think that's why Earls filed the second 2 charges a day later.

Who screwed up here- did the Republican Lege criminalize something that wasn't a crime, or is DeLay admitting to a criminal deed that merely wasn't legally a crime at the time?
