Then why is he so fired up about the judge assigned to his case? Aren't judges supposed to be impartial? I think he's scared to death and will try anything to get out of his self created mess, including having his attorney lie in court. But then what do I know? I'm just some poor old misguided Liberal. Sorry about the lateness of this post, I realize this has probably been discussed earlier, but I was unavailable last week.

Judges should always avoid even the appearance of partiality. Unfortunately, regardless how fair and impartial, he's given DeLay and his henchmen a stick to beat him with.

Could DeLay say he wouldn't get a fair shake?
The judge donated to Move On for the Kerry campaign and he clearly stated that he voted for John Kerry.
As a citizen he has that right.
Would he have been ok with DeLay if he had voted for Bush and donated to the KKK? I bet he would!

Saying that a judge who is openly a Democrat can't act fairly in the trial of a Republican politician is like saying that a black judge can't act fairly in the trial of a white man.
What's the alternative, anyway? A Republican judge? How is that any more fair? There are many states where judges are elected on partisan tickets. If the "MoveOn" argument is valid, there are many places where a politician couldn't get a fair trial.
