Why was Rove never prosecuted in the Texas gubernatorial...

Why was Rove never prosecuted in the Texas gubernatorial...
case where, supposedly, he bugged himself, and called the police and a press conference ( in that order) on the night before the gubernatorial debate. (This was well before W's reign... I believe Mark White was the DEM candidate.)

Police reported Rove put the device there himself. Isn't that a crime in Texas?

If memory serves, it put White on the defensive just before the debate and a republican ( possibly that moron, Clayton Williams) won the election.

Was it a GOP DA?

1. Never proved
that Rove "bugged" himself...there was a lot of suspicion because the "bug" was pretty amateurish but not direct proof or smoking gun that it was Rove himself....
