Bush chooses Samuel Alito for SC seat.
Edited on Mon Oct-31-05 06:21 AM by Maddy McCall
I've read in other places that he will be another Antonin Scalia.

Now the right will be happy and the left is forced to attack.

Democratic representatives, it's time to filibuster your hearts out.

:grr:

Edit to add: 55 years old. On 3rd District Court since 1990.

2. ah, so the harriet miers nomination was to deflect anti-woman talk
Edited on Mon Oct-31-05 06:28 AM by unblock
he couldn't just come out and yank a seat back from women. first, he nominated a female red herring, then he leaked that the shortlist of 3 had 2 women on it, gee, too bad ladies, had to go with the dude....

i am more convinced than ever, as i suspected from the start -- miers' nomination was never intended to succeed. it was always intended as a smokescreen.

6. That is so DAMN transparent...
Hey, I'm not a foaming at the mouth radical about women's rights, but having a daughter, I'm very PRO-WOMEN being represented in OUR Country's leadership.

Think about this = over HALF the population is female YET we will only have ONE, count her, *ONE woman* on the supreme court after O'Connor's replaced.

That's just plain sad. :(

I can understand why our swaggering USA government is NOT ready for a Woman President, but dammit! - Having Only ONE representative on the supreme court for HALF the population of the USA is f'ing ridiculous! :puke:  /rant off

Thank-you <Sr. Mary Elephant> :yoiks:

14. This link may shed some light on it
http://www.fjc.gov/history/home.nsf/autoframe?openform&top=/history/home.nsf/page/judgessitecontent&nav=history/home.nsf/page/judges_nav&page=/history/tbiographical.html

There are 2816 male federal judges vs 248 female

That's about 9% female.

This problem is rooted deeper than just the Supreme Court.

7. You know, I said that last week.
No one agreed with me. But I truly believe it was.

Women are fucked if this guy is confirmed.

10. Oh, I agreed with you MM
but as a low count poster didn't want to feel the heat. This is not a choice who will represent the needs and rights of women.

12. I whole heartedly agree with you.
to add: the smokescreen AKA Harriet Myers, was IMO to control the airwaves because the *hit was hitting the fan in his admin. Additionally, to second your opinion, this is exactly who he wanted in the first place. Myers was never EVER meant to sit as SCOTUS.

Now, what better way to control the issues again, since he's more in the dumps than ever (we know he's going to have the press sucking, media *ucking, fight with this nomination)... He nominates the man who will overturn Roe vs. Wade and it's a done deal in my book. Roe is gone and I'll now start lighting a candle at night, after all, we are in even darker times.

To conclude, until this president's term is over, or he is out of there, (hopefully, by the indignant way he deserves to be), we are going to slide further and further into some seriously BAD times.
The only thing I can think of doing is to focus SHARPLY and aggressively on 2006. That's where we can make the best change for our country, and it will only be the beginning, for our country to begin the climb out of this abyss.

3. Let's get ready to rumbllllllllllllllle!
This is it everybody. This is the battle we have been preparing for. All of the other battles over judicial nominees were just the preliminaries. This is the real thing! This is not a drill.
Filibuster. We have no other option. Scalia's clone CANNOT be allowed to further soil the formerly great insitution known as the "Supreme Court". He must be rejected, and government operations must be shut down until his name is withdrawn.
Do not listen to any arguments about "up or down votes". The Miers situation proved that the Republicans are just fine with people being denied "up or down votes". The Miers situation also proved that the Republicans are just fine with people being denied seats on the court because of their relative degree of conservatism.
Alito, your fifteen minutes of fame begins and ends today.

18. A list of Alito's actions that make him unfit for the Supreme Court
http://thinkprogress.org/2005/10/31/samuel-alitos-america

Samuel Alito’s America

ALITO WOULD OVERTURN ROE V. WADE: In his dissenting opinion in Planned Parenthood v. Casey, Alito concurred with the majority in supporting the restrictive abortion-related measures passed by the Pennsylvania legislature in the late 1980’s. Alito went further, however, saying the majority was wrong to strike down a requirement that women notify their spouses before having an abortion. The Supreme Court later rejected Alito’s view, voting to reaffirm Roe v. Wade.

ALITO WOULD ALLOW RACE-BASED DISCRIMINATION: Alito dissented from a decision in favor of a Marriott Hotel manager who said she had been discriminated against on the basis of race. The majority explained that Alito would have protected racist employers by “immuniz an employer from the reach of Title VII if the employer’s belief that it had selected the ‘best’ candidate was the result of conscious racial bias.”

ALITO WOULD ALLOW DISABILITY-BASED DISCRIMINATION: In Nathanson v. Medical College of Pennsylvania, the majority said the standard for proving disability-based discrimination articulated in Alito’s dissent was so restrictive that “few if any…cases would survive summary judgment.”

ALITO WOULD STRIKE DOWN THE FAMILY AND MEDICAL LEAVE ACT: The Family and Medical Leave Act (FMLA) “guarantees most workers up to 12 weeks of unpaid leave to care for a loved one.” The 2003 Supreme Court ruling upholding FMLA essentially reversed a 2000 decision by Alito which found that Congress exceeded its power in passing the law.

ALITO SUPPORTS UNAUTHORIZED STRIP SEARCHES: In Doe v. Groody, Alito agued that police officers had not violated constitutional rights when they strip searched a mother and her ten-year-old daughter while carrying out a search warrant that authorized only the search of a man and his home.

ALITO HOSTILE TOWARD IMMIGRANTS: In two cases involving the deportation of immigrants, the majority twice noted Alito’s disregard of settled law. In Dia v. Ashcroft, the majority opinion states that Alito’s dissent “guts the statutory standard” and “ignores our precedent.” In Ki Se Lee v. Ashcroft, the majority stated Alito’s opinion contradicted “well-recognized rules of statutory construction.”

9. Rumble.
Who are we going to use to "rumble" with? The Dirty 7 are still around to block any attempt to filibuster and even without them the chances of a filibuster appeared to be remote.

16. Guess its back to the ads asking for the Senate to give Alito
An "up or down vote".Never mind they didnt want Harriet Miers anywhere near a Senate confirmation hearing and ran ads to to prevent it,the hypocrites.

I hope finally the Dems show some spine and really fight the f'ers on this.Win or lose.

If the Dems dont get hot and bothered over this issue then nothing will and we will be screwed in 06' and 08' and this country will be finished.

It will be interesting to see if the "nuclear option" is rolled out again. They got Roberts, they got the Miers nomination withdrawn. If they threaten it now then I want to see ads reminding people of this all over the airwaves, hello Movon.org.

Ads that tell people that the far right despite getting what they wanted with the last two nominees, would rather see this country torn apart then to have to work with their colleagues on the other side of the aisle and
a majority of Americans who support Roe V. Wade, privacy and many other issues.
