Alito makes me wish that Miers was still in the running for SC
Yes, she was a Bush lackey, but there was enough questions about her judicial temperment and how she would ultimately vote that it was conservative republicans who defeated her. Alito may not be a Bush lackey, but my feeling is that he is a skinnier Scalia--and that scares the hell out of me.

I doubt he can be defeated, but I hope the Democrats will make an effort.

1. That was my argument all along
I felt that those screaming for Miers to be gone were advocating trading a possible moderate (she supported Dems and pro-choice candidates) for a known extremist. Of course I was ruthlessly flamed for suggesting that we should do anything other then oppose anyone bush nominated.

2. Well there it is
The fact is that this website is going to hate no matter who President Bush puts up. There is 0% chance of us liking or admiring one of his candidates. Once you accept that you are going to get someone who sucks, you can make value calls between degrees of suckiness. But as long as you still have the illusion that persistant work can get a decent candidate to the court with President Bush doing the nominating, well you see all the sucky candidates as basically the same.

That said, let's not forget that it was the Republicans who sunk Miers not the Liberals nor the Democrats.

7. Yes, the neo-con supporters sunk the nomination.
I certainly didn't like her. I just felt that she may be the lesser of two evils. There is no way that he would appoint someone who acceptable to us. So the as you say, it's all about the degree of suckiness.

There are those who will flame you even when you agree with them on goals. You have to agree with them on the strategy and tactics, too, or you get called a RW'er, either directly or indirectly.

I think this is, well, stupid, as we cannot win every battle, and need to do the things that gain us the most where we are strong, and lose us the least where we are weak. Unfortunately, that requires being less than ideologically pure at times.

Miers would have been destroyed in the hearings, and lots of good stuff would have come out about (or at least been brought up) about the whole AWOL issue, and the funeralgate stuff too..and the changed drivers license number stuff..

the dems should have welcomed her to the hearings:)

6. It wasn't Dems that shot her down, it was Fundies.
Reid, for instance, made positive comments about her. Senate Dems thought they were dodging a bullet, but I was critical of that position. My objection to Miers was that I believed that Bush was appointing her to immunize members of his administration against criminal prosecution. I still believe that. There really wasn't any other reason for Bush to appoint her.

So it's a double-edged sword: Gays liked her; it wasn't clear where she stood on choice; but, she would doubtlessly back the President with regards to executive privilege and his claim to expanded Presidential authority to jail anybody he pleases, in secret, without due process, and have them tortured.

Pick your poison.

5. I'm willing to take a far bigger gamble, so in a way I am pleased...
fight this hard...if we lose, let America see a true Conservative Court. I'm willing to bet a long, long Democratic run will follow.
