What "extraordinary circumstances" will gain traction?
The gang of 14 will need something substantive to plausibly justify breaking the filibuster agreement.

The right wing is already trying to box them in -- well-qualified jurist, previously confirmed in the Senate by unanimous vote, blah blah blah.

What's out there that is "extraordinary" to overcome these talking points?

1. Believes in judicial intrusion into marital communication.
Also, opposing FMLA is AGAINST family.

4. Was it judicial intrusion?
My understanding is that it was actually legislative intrusion, and Alito failed to stop it.

10. Federal law trumps state law
By supporting an UNCONSTITUTIONAL state law he is a judicial activist.

2. IT doesn't matter, the point is to force the bastards to nuke
Filibuster, then the Repukes go nuke, the Dems shut down the Senate.

MAD

Either they filibuster, or they are done. The Dems have no choice.

3. I know you want a filibuster
But the Democratic members in the gang of 14 promised not to do so absent "extraordinary circumstances."

Don't you think they'd need something "extraordinary" to to hang their hat on so they can claim they're not breaking the agreement?

7. What by your definition would be "extraordinary circumstances"?
If it's not this nomination, I would suggests that there is really no set of "extraordinary circumstances" that would exist to fillibuster a nominee, and that they would then have to be classified as MYTHICAL! One would hope in crafting that agreement, that the understanding was that the president would be making an effort to nominate someone qualified, and not ideologically bent on a certain agenda, which this nomination appears to be. If Bush is not following that spirit, then why should the Dems honor this agreement? It's been broken now.

11. I don't think we'll have too much of a problem with the Democratic 7.
It's the other 7 that will probably fall along the Republican lines, or at least 5 of them will. Which is fine by me - I think this guy is worthy of a nuclear fight, especially with Presidential and Congressional approval ratings "soaring" around 35%.

12. It really doesn't matter, as long as the Democrats FILIBUSTER!
Edited on Mon Oct-31-05 01:58 PM by Village Idiot
Let the Repugnicans do what the Rethuglicans CAN do - "nuclear option" or no - the Democratic party must stick to its guns at this point, and shut the Senate DOWN.

The RW currently controls nearly ALL facets of the US government - why in the world would anyone want to HELP them control more of it?
