so does "socialists" and "communists" and "legislating from the bench".

On that last one - if as a supreme court justice you rule on a point of law, you are by definition legislating from the bench. That's the point of judicial opinion; to remove ambiguity and bring clarity to interpreting the law and enacted legislation.

What part of that do they not get? That is why it is so important to pick someone whose proven personal values place a fair interpretation of the law for Americans by Americans above pursuing a personal political agenda.
