Bush Makes Appointments Bypassing Senate
January 4th, 2006

Bush bypassed the Senate today to a make a few recess appointments including installing former Navy Secretary Gordon R. England as deputy secretary of defense. Before joining the Bush administration in 2001, Gordon England was an executive at General Dynamics Corp. Chalk up another corporate cronies in Bush’s stable.

The Constitution allows that the president may circumvent the Senate confirmation process by making these recess appointments while the Senate is in recess. Recess appointments normally expire at the end of next congressional session. However, since the Senate held a pro forma session on Tuesday and then adjourned, the White House is contending that the second session of the 109th Congress has started and that makes Bush’s recess appointments are valid until the session ends at the end of 2007.

1. the second session of the 109th Congress has started hasn't it?

The first session adjourned sine die, I thought. So if COngress has convened wouldn't it have to be the second session?

3. Bush avoiding confirmation hearings
where his appointees will be forced to answer questions. Any questions. This admin. is entirely not interested in answering questions.

4. I don't like Bush bypassing the Senate on appointments
For example John Bolton, the Dems did a great job filabustering the guy who said: "if three stories of the U.N building were destroyed, who would care?" Instead Bush waited till the August recess to bypass him to the U.N.

Just makes me sick.

7. Not just cronies.
EG, the Bolton hearings, when they started digging around in his use of NSA intercepts. Or EG, when the Gonzales hearings, when they get assurances that the nominee will tell congress when something illegal happens.

saw any reason to HAVE such a thing as a "senate" in the first place, this wouldn't be allowed to stand..
