In a 4-1 ruling Thursday, the South Dakota Supreme Court said the former four-term governor, who resigned from Congress in 2003 after his manslaughter conviction in the death of Randolph Scott, 55, of Hardwick, Minn., can resume practicing law Feb. 15. That's one year before the suspension of his license was to be lifted.
"While there are public concerns regarding Janklow's driving, there was no evidence presented to suggest that the public needs protection from Janklow's conduct as an attorney," Judge Glen Severson wrote.

Russell Knutson, a farmer from Magnolia and a friend of Randolph Scott and his family, agreed. "My gut feeling is that he shouldn't get it back until the three years are up," Knutson said. "But there isn't too much we can do about it. That's our legal system."
But the ruling disappointed members of Scott's family, who have been frustrated by Janklow's attempts to fight the charges against him and, later, challenge his conviction and part of the sentence imposed.
