Political WIN for Dems to Fillibuster SCALITO, Here is the Math
Here is the poll that I got from another thread:

"The poll, released today, shows 49 percent of Americans want the Senate to vote to confirm Alito while 30 percent do not and 21 percent have no opinion on the matter, according to Gallup News Service analyst Jeffrey M. Jones."

But wait. It gets more complicated.

"Republicans strongly favor Alito's confirmation, with 73 percent in favor and just 11 percent opposed. Independents also slightly favor Alito, with 41 supporting confirmation and 36 percent opposing him.

"Democrats are more likely to oppose the nomination than favor it, but their opposition is not very strong. Some 46 percent opposed Alito, while 34 percent expressed support."

Now, here is the important part.

"If Americans become convinced Alito would vote to overturn Roe vs. Wade, the privacy case that cleared the way for legalized abortion, then a majority of Americans--56 percent--said they would oppose his nomination."

While it is impossible to know how Scalito would vote if he were never confirmed, if Dems fillibuster him and keep him off the SCOTUS, Democratic voters will believe De, senators when they say that he would have voted to overturn Roe v. Wade. A fillibuster will mobilize the Democratic base. On the other hand, if the Dems do nothing and he gets on the court and votes to overturn Roe v. Wade the base may punish the Dems for not protecting their rights. Meanhwile the GOP base will be lead to poll with some other non issue along the lines of gay marriage.

Therefore, the Democrats in the Senate MUST fillibuster this right wing whacko, because it is the correct thing politically as well as morally. If the Republicans want to go nuclear, let them. It is their funeral. They will suffer for it this fall.

Shit... I like the upside possibility of this. Roe v. Wade should be the focus!

3. The reverse is also true
If the Dems DON'T filibuster Alito, then they look weak, ineffectual, and incapable of strong leadership- and they lose the independents and fence sitters, who may just stay home.

Considering Alito's ethical problems- if they punt on this- with SO MANY issues at stake (and in their favor) it sets the tone for the whole year- and I predict it will result in a 7th straight congressional election loss.

6. Filibuster a good idea.
will be magnified with debate over the "nuclear" option, bring much more coverage of the issue. Time to take a stand now.
