The ONLY Way Bush Will Ever Nominate A Moderate
to the Supreme Court is if we take back the Senate. Look, there's not going to be a filibuster over Alito. For one thing, they failed to damage him in Committee, for another, a filibuster would not get us a more moderate nominee. We need to work our butts off to elect dems to the Senate. I know a lot of people here are very pro filibuster, and I understand the passion to keep this anti-democratic, ideological judge from becoming a justice, but I hope those who are so passionate about this, can move beyond it.

1. But, when more "voting fraud" cases
come before the SCOTUS after Alito's empaneling, count on him either to throw them out or to rule in favor of the fraudsters. How are ya' gonna get either house back with things in this shape? SG

2. actually, a filibuster WOULD get us a 'more' moderate nominee
although i agree that the result would still be noticeably to the right of sandra day o'conner.

3. I only wish you were right.
The most likely outcome to a filibuster is the loathsome nuke option. they've been itching to do it.

4. i should say a "successful' filibuster ...
but i think there's also an advantage in accepting their dare to do the nuclear option.

i personally have my doubts that they would actually do it. they could actually have done this already but have chosen not to. i think it's more of a bluff than anything else. having said that, these guys are crazy enough to actually do it.

but if they did, there's political advantage in that as well. democrats could scream bloody murder at some of the lies the republicans would be uttering on the senate floor. i think it would make a democratic takeover of the senate far more likely, it would be a HUGE rallying point not only for the base, but also for independents and anyone else who cares about the constitution.

I'm not convinced that the scenario you describe is the one that would play out, but I think it's almost worth it to find out.
