Roe v Wade and states' rights
While the chance that Roe v Wade might be overturned in the future is a possibility, I think we all need to remember that it is a Federal law, and that legal and safe abortion won't be "wiped out" across the country, regardless of what happens in the Federal Court. Every state has its own rules in respect to abortion and while not every state continues to allow it without restrictions, most states will continue to allow abortions without the federal law being there.

1. Yes they will
BUT the Freepers already know this. They call it a first step, before they try to pass FEDERAL laws banning it, a la, PBA.

They had something amounting to almost 200 postings on "NYC is the Abortion Capital of the Country". You KNOW if Roe is overturned, they will be targeting these cities and states who WON'T comply with FEDERAL laws.

2. True.
Republicans love to claim "state's rights" whenever it fits their needs. When it's something they don't like (gay marriage, abortion, medical marijuana), then they scream bloody murder until there's federal regulation outlawing it.

Fucking hypocrites.

And evil.

3. Well, CA passed an initiative
legalizing medical marijuana. SCOTUS struck it down. So much for state's rights. I can see the same thing happening with abortion. If Roe gets overturned just wait to see what happens to the state laws. Watch SCOTUS strike abortion rights laws down just like they did for medical marijuana. Federal law trumps state law.

All this might take a while for an actual ban on abortions becoming federal law, but I can see it happening.

Do the people's rights mean anything, or was Jefferson wasting his time writing them because we let him down and abdicated governance to the federalist elites in the end.

This makes me madder than hell. Your post was almost dreamy in its soft treatment of what will be a DISASTER for women in antichoice states, and eventually for all women, if the fundies have their way, and believe you me they are already be planning to take care of those evil prochoice states!

Sorry to be so emotional, but I just can't sit by and read these Oh so nice posts about how it won't be so bad when Roe is overturned, all we'll have to do is sponsor bus trips to prochoice states.

Good god! What is the matter with people on DU?? Don't you think the RW has been thinking about this as long as we have??? Please grow a brain cell or two!!!

There is NO WAY that this group of fanatical criminals are going to let prochoice states off the hook. Once they take over the federal legislature they will pass laws to prevent women from crossing state lines to get an abortion. Of course, it is difficult to enforce, they'll find a way (at least to harass the poorest and the youngest women, as they always do!). And you can forget about taking it to the Supreme Court, once Alito get confirmed.

Sorry to be in such a distopic mood here. But please folks look at reality. I hope for 2006, I really do. I will work my heart and soul out for it for Dems, but let's be realistic.
