The strategy is make this as painful and public for as many people as possible. The theory is obviously that no one has the appetite for protracted litigation.

The more they are going to start criticizing Fitz. Violating their "constitutional rights," you know. That's really a big deal when it's their rights, while they sit back and let Bush destroy those of the rest of us.

You know the press isn't going to testify willingly indeed the reporters would probably love to be martyred with a contempt of court citation.
If all the reporters refuse to testify, then the defense can argue it is prevented from presenting an effective defense and go for a mistrial.
On edit: If Luskin can get even one reporter to refuse to testify he may be able to get his mistrial.
This strategy is great for the defense. Nothing hangs on scooter's guilt.

I think after coming this far, they're not going to declare a mistrial just because a couple of reporters wouldn't testify. I imagine the same fate that met Ms. miller would also await any such reporters. A contempt charge and a stint in jail, until they see fit to open their lying pieholes.
