Alito's probale pending confirmation does suck and is a set back. But it is not a death blow. There will still be 5 votes to protect Roe v. Wade and other matters important to us. Kennedy is not a complete puppit of Scalia and there will still be some balance on the court. But if Bush gets one more pick it is match point for a womens right to chose. And it is also that important that we win in 2008.

3. That's why 2008 is important...
If a Democrat wins the White House in 2008 chances are he or she will be choosing the replacement for Justice Scalia.

In 2009 Scalia will turn 73 so if a Democrat is re-elected in 2012 by the time he or she leaves office Scalia will be 80 going on 81.

So there is a great chance a liberal may replace Scalia.
