"Judges must be servants of the law and not legislate from the bench"
Folks;

That is the battle cry of racists across the land. That shit didnt start with Roe V Wade. That shit started with Brown V Board of Ed!!!!!!

Conservatives didnt like that "all deliberate speed" business and have been attacking the courts ever since. Bush just sent a shout out to all his racist supporters in the SOTU address. I think an average fool who fucked up with the kiatrina disaster would avoid that kind of language. Bush is no average fool, he's exceptional!!!!!

Liberals across the blogosphere would do well to hammer that point home. That talking point needs to be put to bed and conservatives noses rubbed into it whenever they bring it up. One thing is certain, Bush is no student of history.

2. Presidents must be servants of the law and not break the law from the oval

3. "Judge-made" law IS a legitimate part of the law and has been with us
for centuries, if not longer. There are just a lot of areas where the legislative branch has not spoken or has not spoken clearly. It is the JOB of the judiciary to "make law" in these areas. It is also their job to INVALIDATE laws that are unconstitutional, regardless of who makes them.

4. There certainly are a lot of servants lately. You sure this isn't the
guided age?

5. Yes, judges are the 3rd leg of the tripod, and should be able to
create new laws just as congress and president can.

6. Unless, of course, it's a Conservative on the bench
then it's okay.

Unless, of course, one of those pesky Reagan appointees decides against us. Then we'll label them liberal, and activist.
