I'm not a lawyer.

1st Degree?

Manslaughter?

Negligent Homicide?

Hunter Shot by Cheney Has Heart Attack
AP - 1 hour, 38 minutes ago

CORPUS CHRISTI, Texas - The 78-year-old lawyer who was shot by Vice President Dick Cheney in a hunting accident has some birdshot in or touching his heart and he had "a silent heart attack" Tuesday morning, hospital officials said. The victim, Harry Whittington, was immediately moved back to the intensive care unit for further treatment, said Peter Banko, the administrator at Christus Spohn Hospital Corpus Christi-Memorial in Texas.

1. Accidental manslaughter.
But hang him high anyway! (Isn't that what they do in Texas?)

7. actually from what i've heard whittington was wrong. he did not
say that he was there. but my opinion of hunters getting accidentally shot -- well they shouldn't be out there killing defenseless animals and birds. so i can't feel sympathy for any of them. but i hope cheney is charged with something.

3. treason, accepting bribes, mass murder
whittington's murder pales in comparison to his other crimes.

4. Probably no charges but maybe involuntary manslaughter
The same as when someone kills someone in a car accident when negligence is involved. If gross negligence is not involved then like a car accident - no charges.

5. Bah! I'm thinking MEDAL OF FREEDOM time!!
Ordinarily, this would be a negligent homicide case, however, if the guy dies.

6. Killing a Human in mistake for game
That's actually a law in Pennsylvania. It was a misdemeanor last I looked, but it may be a felony by now.
