1 HOUSE JOINT RESOLUTION


2 WHEREAS, Section 603 of Jefferson's Manual of the Rules of
3 the United States House of Representatives allows federal
4 impeachment proceedings to be initiated by joint resolution of
5 a state legislature; and

6 WHEREAS, President Bush has publicly admitted to ordering
7 the National Security Agency to violate provisions of the 1978
8 Foreign Intelligence Surveillance Act, a felony, specifically
9 authorizing the Agency to spy on American citizens without
10 warrant; and

11 WHEREAS, Evidence suggests that President Bush authorized
12 violation of the Torture Convention of the Geneva Conventions,
13 a treaty regarded a supreme law by the United States
14 Constitution; and

15 WHEREAS, The Bush Administration has held American
16 citizens and citizens of other nations as prisoners of war
17 without charge or trial; and

18 WHEREAS, Evidence suggests that the Bush Administration
19 has manipulated intelligence for the purpose of initiating a
20 war against the sovereign nation of Iraq, resulting in the
21 deaths of large numbers of Iraqi civilians and causing the
22 United States to incur loss of life, diminished security and
23 billions of dollars in unnecessary expenses; and

24 WHEREAS, The Bush Administration leaked classified
25 national secrets to further a political agenda, exposing an
26 unknown number of covert U. S. intelligence agents to potential
27 harm and retribution while simultaneously refusing to
28 investigate the matter; and

29 WHEREAS, The Republican-controlled Congress has declined

1 to fully investigate these charges to date; therefore, be it

2 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
3 NINETY-FOURTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
4 SENATE CONCURRING HEREIN, that the General Assembly of the
5 State of Illinois has good cause to submit charges to the U. S.
6 House of Representatives under Section 603 that the President
7 of the United States has willfully violated his Oath of Office
8 to preserve, protect and defend the Constitution of the United
9 States; and be it further

10 RESOLVED, That George W. Bush, if found guilty of the
11 charges contained herein, should be removed from office and
12 disqualified to hold any other office in the United States.

but is this a bit pre-mature? Congress isn't balanced in a way that impeachment could take place... or is it...I'm a bit confused now. Illinois can ask for impeachment, but isn't it the House of Reps that actually draws up the articles? If so, there's not enough anti-bush power in the House...Yet.

There is a little known set of supplementary rules for both the US Senate and House of Representatives developed by Thomas Jefferson. Jefferson was clear on his opposition to centralized federal power and frequently sought balances giving states greater liberties and rights. Jefferson’s rules, Section 603, state:

Inception of impeachment proceedings in the House: … there are various methods of setting an impeachment in motion: by charges made on the floor on the responsibility of a Member or Delegate; by charges preferred by a memorial, which is usually referred to a committee for examination; by a resolution dropped in the hopper by a Member and referred to a committee; by a message from the President; by charges transmitted from the legislature of a State or territory or from a grand jury…”

The language in Jefferson’s parliamentary guidelines is clear. State legislatures can set “an impeachment in motion” with a “Joint Resolution” approved by the legislature (both the state Senate and Assembly). No state has taken advantage of this provision. In fact, it is so obscure; the majority of Vermont legislators who asked for impeachment did so in a formal letter to the House of Representatives rather than invoking Jefferson’s Rule 603.

1) it is an election year, and someone else came up with the idea. If it's not his idea, it is a bad idea.
2) Despite a clear Dem majority in both houses, and his being a Dem gov., see point #1.
3) It is an election year, and Bloggo will not risk insulting his good friend George. They are alike as getting into office totally on their long resumes and individual backgrounds, training, experience and lack of interference by family members.

5) He won't risk insulting the GOPers who hate George Ryan and his clone, Judy Barr Topinka (his opponent for gov).

13. Its a resolution not a law so you might be correct. . .
. . .which may be the reason it may pass. If it were a law the political stakes might be too high for a lot of Democrats. I don't expect a lot of the downstate Dems to support the resolution.

. . .it is only a symbolic gesture at this point it would be stupid for him to sign it. Seriously think about it. Now if this resolution were offered up with a Democratic majority in the the US Congress it would be different.

I think the statement that it sends if it passes both houses of the Illinois legislature is strong enough.

I can't for the life of me understand why any self respecting Democrat in the state of Illinois would expect the Democrat governor to sacrifice his office for what is a symbolic gesture. I support this movement but will not penalize the governor for not supporting it. Let's not bite our nose off to spite our face.

dan walker, George Ryan and Jim Thompson as governors. No. Bloggo is worse. He is a media whore, not a leader. He talks to his mirror first, then a camera. The last thing on his list is the State of Illinois or its citizens. What tops his list is his plan to run for president. He will sing his Elvis way into the role of Captain Fantastic of the World, which will be followed by his promotion to Galactic Emperor with Zing in his magic wand of power. Bloggo is an embarrrassment for the Democrats. Then again, in Illinois, both parties are embarrassing to anyone who expects legal, ethical behavior from their elected pols.

gosh no. But as the worse of two evils, it is a tough choice.
Bloggo will get indicted his next term, and that will lead to a DEM down fall allowing shitheads like Oberallesweis and other neonazis to take control. If we do not control and clean up our own problems we seed the future for an opportunity for really nasty GOP criminals to replace us. THAT is why Bloggo is so bad for us and the state.

Jefferson was concerned about exactly these kinds of abuses by too-powerful Executives and left us this trap door for States, when Congress isn't doing its oversight job, as part of his glorious legacy. The IL Governor can't veto it, by the way, if it passes - by US House rules it goes straight to the floor in DC where also by their rules they must cease all other activity and take up the question. Whether Denny Hastert wants to or not."

Folks this can happen but it won't happen without grassroots support. We need to organize we need to calle-mail legislators, we need to involve as many people as possible. Speaker Madigan is not going to be in any rush to call this bill and we have to make sure he calls it with enough time for it to make it to the Senate and who knows how Senate President Jones feels. The legislature was supposed to adjourn on April 6 (they have until May 31 before its considered overtime) so we may only have a week to work. If nothing happens in the next week or two (before session ends) it may get tabled until Veto session which is in November/December. We need DUers to step up this weekend. . .reach out to other activists and make this thing happen.

1st step call or e-mail you state rep and state senator by Monday. Encourage your friends and family to do so as well! IF YOU DO NOT LIVE IN ILLINOIS CALL FRIENDS AND FAMILY WHO DO!!! Hit other boards, blogs and progressive activists. The establishment (and I am part of it, an insider who will do what he can) will not do anything without OVERWHELMING support from the people.

2nd target legislators who you think may support this resolution and list them on the DU. I have a GUT feeling leadership (Madigan/Jones) is going to be luke warm at best and Rod has no say so in this effort, so it will REQUIRE major grassroots efforts!
