Wal-Mart Canada tried to convince a Queen's Bench justice Thursday that the Saskatchewan Labour Relations Board (SLRB) appears biased, a claim disputed by the SLRB, the provincial government and the union trying to organize Wal-Mart workers in Saskatchewan.

Justice Frank Gerein heard several hours of arguments Thursday and will rule at a future, unspecified date.

The case is being closely watched by many powerful interests. Lawyers for the province's attorney general, for Foot Locker Canada Inc., for Wal-Mart workers opposed to unionization and others listened intently to the proceedings from the public gallery.

Wal-Mart claims to have a "reasonable apprehension" that the board is biased. Wal-Mart claims the SLRB "has and will continue to breach the rules of natural justice in failing to provide a fair hearing to the applicant."

Wal-Mart is asking that the SLRB members hearing several Wal-Mart cases be terminated, Wal-Mart lawyer John Beckman said.

In his submission to Gerein, Beckman relied heavily on the affidavit of former SLRB vice-chair Walter Matkowski.

1. Wal-Mart is the opposite of workplace democracy
Workers have no voice, so there is no chance for change unless Wal-Mart says so.
