How long after the elections does Bush have to protect himself?

How long after the elections does Bush have to protect himself?
If the Democrats take back the House and or Senate, there is still a period before the new politicians actually take control.
How long is this? Several weeks? Several months?

If you have a completely un-moral president and v.p. in the White House, they might use this time to create a situation to protect
themselves.

If there was an actual major state of emergency, the new Congress would have to concentrate on that instead of them.
They is doing this now of course, in a smaller way, (we are in a state of war so I can do what I like).

If they, for example, inflamed a situation so that a major world war broke out, it would be difficult for Congress to move against them until the situation was resolving.

Anyone think this kind of idea is being kicked around in the White House around now?

By the way, a Neocon letter to Bush in 2001 refers to only 3 major enemies of the U.S.
Osama bin Laden, Saddam Hussein, and HEZBOLLAH. They also state that Israel is our major ally.
It seems that this Israeli war against Hezbollah, comes right out of page two of the Neocon playbook.
