It seems to me that I heard that they traced the aim's and emails back to Foley's computer. If they cant find them on that computer itself,it would seem to be proof that someone tampered with evidence

Disk wipe programs, though good enough to erase info from a pc you just intend to sell or donate, won't remove 100% of the magnetic evidence on a disk. Modern forensics labs can usually find enough of a match to hold up in court.
