Is the Terror Bill void?? It was more than 10 days when W signed it! |
|
Edited on Tue Oct-17-06 10:04 PM by AZBlue
According to the Constitution, once a bill is presented to the President, he has 10 days (excluding Sundays) to sign it or it is void. I believe that it was presented to him on the 29th. George W took more than 10 days to sign the terror bill - so is it really even legit now?? This one issue should be enough to block it completely and make them start all over again. Does anyone know when it was officially presented to him?
(edit - forgot to give credit where credit is due - this was brought up on the local AAR)

Void? Nah, it would be a law, same as if he had signed it.

If Congress is not in session, the bill does not become law if the President does not sign it within 10 days. But as pointed out above, the bill was "presented" on 10/10/2006. Of the 5 bills introduced between 9/20 and 9/30, it was the latest to be "presented". Those bills are:
1. <109th> H.R.6138 : To temporarily extend the programs under the Higher Education Act of 1965, and for other purposes. Sponsor: Rep Keller, Ric (introduced 9/21/2006) Cosponsors (2) Committees: House Education and the Workforce Latest Major Action: Became Public Law No: 109-292
2. <109th> H.R.6159 : To extend temporarily certain authorities of the Small Business Administration. Sponsor: Rep Manzullo, Donald A. (introduced 9/25/2006) Cosponsors (None) Committees: House Small Business Latest Major Action: Became Public Law No: 109-316
3. <109th> H.R.6197 : To amend the Older American Act of 1965 to authorize appropriations for fiscal years 2007 through 2011, and for other purposes. Sponsor: Rep Tiberi, Patrick J. (introduced 9/27/2006) Cosponsors (19) Committees: House Education and the Workforce Latest Major Action: 10/6/2006 Presented to President.
4. <109th> H.R.6198 : To hold the current regime in Iran accountable for its threatening behavior and to support a transition to democracy in Iran. Sponsor: Rep Ros-Lehtinen, Ileana (introduced 9/27/2006) Cosponsors (3) Committees: House International Relations; House Financial Services Latest Major Action: Became Public Law No: 109-293
5. <109th> S.3930 : A bill to authorize trial by military commission for violations of the law of war, and for other purposes. Sponsor: Sen McConnell, Mitch (introduced 9/22/2006) Cosponsors (2) Latest Major Action: 10/10/2006 Presented to President.

7. The point is moot because of the date it was presented to him. |
|
However, if it's not signed within 10 days and congress is adjourned within those 10 days, it does not become law (ie, it is void).
