Ohio Lawsuit to Reinstate hundreds of thousands of Purged Democratic
Voters to be Filed Fri or Monday

Ohio voting rights activist and attorney, Bob Fitrakis, says the Ohio
elections may have already been won, responding to reports of massive
voter purges in Democratic precincts.

Dr. Fitrakis, told OpEdNews, "Essentially, by purging these rolls, the
Republicans, by shrinking the electorate, have already won in Ohio. If
they can't win, which is what the polls show among registered voters,
the way to win is to use their nuclear option-- to target black
voters, young voters and the working poor-- by purging them so they
can't vote.

Reports indicate that starting as early as shortly after the 2004
presidential elections, but particularly recently, hundreds of
thousands of voters-- mostly urban apartment dwellers (likely black)
and students-- who are primarily Democratic-- were sent notifications
that they would be purged from the eligible voter lists if they did
not respond the letter. But, reportedly, the letter was designed to be
easily overlooked, perhaps treated as junk mail. Failure to send in a
response caused the voter to be removed from the voting roll.

Fitrakis observes, "They aren't challenging voter eligibility in
Republican areas. This is coming from the republican party. They're
not targeting their own base.

"If it follows the pattern from 2004, they will have purged heavily
Democratic areas.THey will challenge high performance democratic
precincts."

According to Fitrakis, HAVA, the Help America Vote Act, requires
centrally maintained voter records, which would probably have been
kept by secretary of state Ken Blackwell. Fitrack theorizes, that the
voter records w ere "probably purged from the secretary of state's
office, because HAVA mandates a centrally located database. But the
letters would have gone out from the separate county boards of
election."

This is part of the challenge. It may be necessary to actually deal
with each of the 88 counties.

Fitrakis says, "We're up against 88 county prosecutors. That's what
they've been doing for two years. it's been killing us. They say we
have to get the records from the county-- you literally have to fax
phone or show up to literally demand these records."

OpEdNews asked Bob Fitrakis, "What can be done?" "What can voting
integrity activists do?" What can the Democratic party do?

Fitrakis replied, "We're going to try desperately to get to the bottom
of this and try on Friday to get an injuction-- Monday, at the latest.

We asked, "Is there any chance that this can be turned around."

"Yes, A federal judge can issue an order to rein state all the purged
voters." says Fitrakis.

According to Fitrakis, the letters were sent out and purges timed, so
voters could not get their voting eligibility status reinstated,
because the voting registration period just ended. Worse, there was no
reason to purge the voters, which is usually reserved for people who
have died or moved out of state. They should have been moved to
inactive status.

there are minority and student precincts -- i.e., votes for Democrats.

Get your butts out to vote. We only win this with turn out. People here said we are staying home if you do you have no right to say a word again.

secretly like they did in 2004.

Well, now its time to see what the democratic party is really made of. Time to see if they'll allow another election to be stolen.

And that includes US.

If we lose this lawsuit, the 2006 elections are over before they start.
The Repiglicans would sweep Ohio and keep both houses of Congress.

People For the American Way Foundation Investigates Voter Purge Concerns in Ohio

People For the American Way Foundation (PFAWF) today investigated concerns raised by activists that an 11th-hour purge of eligible voters in Ohio could result from mailings sent out by county election officials. While it appears that fears of a purge are unfounded, the incident does emphasize the need for continued voter education, and vigilance in voter advocacy and protection as the November elections loom.

Over the past few days, Internet commentators have raised concerns that certain voters in Ohio might be removed from the voter rolls if mailings sent to them by their county election officials are returned as undelivered. Given the Secretary of State’s history of supporting and engaging in voter suppression strategies, citizen vigilance is necessary and commendable. In this particular case, though, county election officials have confirmed to PFAWF that under Ohio law, even voters whose mailings are returned will be permitted to vote a regular ballot if they show the proper ID at the polls. Of course that’s if poll workers are properly trained.

Precisely to help avoid problems and to foster full participation, People For the American Way Foundation has prepared a brief mailing carefully explaining the Ohio voter ID rules and the proper forms of identification, which is being sent to many thousands of Ohio voters. The mailing can be found at http://media.pfaw.org/ep/OH_Flier.pdf.

“We are working to make sure that Ohio voters have the best information possible in order to cast a vote that counts this Election day,” said Ralph G. Neas, PFAWF president. ”The past two elections have shaken the confidence of the electorate in our system. We must do everything we can to restore voter confidence and bring them to the polls in overwhelming numbers.”

Neas noted that voters who have questions about reports of potential voting problems or who are otherwise concerned about suppression or intimidation tactics can contact the Election Protection Hotline at 1-866-OUR-VOTE, which is sponsored by People For the American Way Foundation, Lawyers’ Committee for Civil Right Under Law and the NAACP. Callers will receive free legal assistance from volunteer lawyers trained in election law, and the coalition will investigate reports of intimidation and suppression to seek recourse.

Unfortunately, there have already been reports of blatant attempts at voter intimidation and suppression in advance of the election. For instance, in Orange County, California, a Republican candidate for the U.S. House has admitted that his campaign sent threatening letters to Hispanic registered voters seeking to intimidate them and suppress their votes. In August, People For the American Way Foundation published “The New Face of Jim Crow: Voter Suppression in America,” which documented the many ways – legislative, regulatory, and otherwise – that barriers are erected to the ballot box: http://www.pfaw.org/go/VoterSuppression.

People For the American Way Foundation’s advocacy affiliate, People For the American Way, had opposed passage of Ohio’s H.B. 3 because PFAW believed its provisions would complicate and discourage voting. And PFAW Foundation worked with allies to mount a successful legal challenge to overly burdensome voter registration regulations the Secretary of State’s office put in place as part of its plan to implement H.B. 3.

18. So, a question - I'm worried here.
If I voted in this year's primaries, and I got the little postcard a couple of weeks ago that announced all Ohio voters now had to have a picture ID, then I'm still registered. Right??

23. From what I have seen, even this won't be enough to elect Blackwell Gov.
same for Dewine. I suspect they would need to purge 1/2 of the state's voters to win.

Blackwell knows he's gonna lose, but instead of doing his dirty tricks on his own race he's gonna take one for the party and instead focus on screwing with the senate race. I hope more than anything that you're right and there's going be such a large margin for Brown that he won't be able to purge enough voters or otherwise sufficiently mess up the election process to affect the outcome.
