Is Bill Nelson going to take the DNC all the way to the Supreme Court?
Well, to be fair he doesn't exactly say that...but his email yesterday says he will not back down. So either he doesn't know that a 1981 Supreme Court ruling favors the DNC's position....or he will destroy the party to be first in line.

I call it a bad case of the "me firsties".

Here is the Supreme Court ruling:

The DNC Can Refuse To Allow Florida To Have Delegates

The 1981 Supreme Court decision for the case Democratic Party of U.S. v. Wisconsin, 450 U.S. 107

The State has a substantial interest in the manner in which its elections are conducted, and the National Party has a substantial interest in the manner in which the delegates to its National Convention are selected. But these interests are not incompatible, and to the limited extent they clash in this case, both interests can be preserved. The National Party rules do not forbid Wisconsin to conduct an open primary. But if Wisconsin does open its primary, it cannot require that Wisconsin delegates to the National Party Convention vote there in accordance with the primary results, if to do so would violate Party rules. Since the Wisconsin Supreme Court has declared that the National Party cannot disqualify delegates who are bound to vote in accordance with the results of the Wisconsin open primary, its judgment is reversed.

It is so ordered.


But Senator Bill Nelson says he won't give up. His email yesterday indicates this is his life passion. He will not back down. Indicators are the state party itself would work to compromise, but Nelson appears to be keeping up the anger toward the DNC and Governor Dean.

From his email:

The DNC says that Florida's earlier primary would alter the sequence of contests in Iowa, Nevada, New Hampshire and South Carolina, and they are threatening to penalize us by stripping our 210 delegates to the national convention. This would essentially take away our right to pick a Democratic presidential nominee.

This is a case of fundamental rights vs. the rules of a political party. We have a right to vote, and to have that vote count, and there is no debating that. We've put the party on notice that if they strip away any of Florida's delegates to the national convention, we're prepared to ask appropriate legal officials whether this could violate any state or federal civil rights laws.

Take a stand today. I need your help. Demand that the DNC allow Florida a fair say. I'm not backing down from this fight.


Maybe he just does not understand the implications of what he and Levin and the 16 other congressional people are doing. My take is that they fully understand it. I believe they want a compliant DNC, compliant to Congress more than the people of the party.

They continued the war yesterday. Florida and Michigan sent a letter asking the DNC why they were not condemning the fact that New Hampshire was talking about moving the primary up. WHY was NH talking about it? Because Michigan just jumped ahead of them.

Now Michigan and Florida are asking the DNC to bully NH because Michigan already bullied that state by moving up ahead of them. Think about that. Michigan broke the primary rules and moved up ahead of New Hampshire, who has not officially moved. Then the good Senator from Michigan tells the DNC they had better punish New Hampshire.

Letter: DNC Silent on N.H. Primary Move

TALLAHASSEE, Fla. - Democratic congressmen from Florida and Michigan asked national party chairman Howard Dean on Tuesday why he has been silent about punishing New Hampshire if it moves up its presidential primary while their states may lose all their delegates. A letter sent to the Democratic National Committee chairman said Florida had been receiving threats months before state Democrats said they would choose their presidential delegates during the Jan. 29 primary that was set by a Republican-led Legislature and GOP governor.

But New Hampshire is talking about moving its Jan. 22 primary to stay ahead of Michigan's Jan. 15 primary and South Carolina Republicans' Jan. 19 primary, and the DNC is saying nothing, the letter said.

"Will the DNC now tell New Hampshire Democrats that they risk losing 100 percent of their pledged and unpledged delegates, in the same way Florida was threatened?" the letter asked.

...""We are proud Democrats, insisting on fairness, and we will fight the selective enforcement of our party's Delegate Selection Rules," said the letter. It was signed by Florida Sen. Bill Nelson, Michigan Sens. Carl Levin and Debbie Stabenow and most of the states' Democratic House members.


All Florida had to do to keep its delegates was to put up a fight when the vote was taken to move the primary up to January. But they did not fight. They helped introduce the bill and they laughed their own amendments off the floor. They ridiculed the DNC rules in public.

Florida's Geller joked about his amendment: "sarcasm and audible laughter in chamber"

The DNC members had handouts that included quotes by House Minority leader Dan Gelber brushing off Howard Dean, and the following transcript of Steve Geller making the motion to move the primary to Feb. 5:

Geller: "...So the Democratic leader and the Democratic leader pro tem are jointly making this motion, which we will duly show them later, that we tried not to have the election on, um, before (Feb. 5).
President: "And so Sen. Geller are you urging a negative vote or would you like us to pass this vote?"
Geller: "Oh no sir. We really, really want this. Don't we senator? (sarcasm and audible laughter in chamber).


And a state representative, Dan Gelber, the one who publicly denounced Howard Dean early this year....admitted they did not fight.

Gelber admits they did not fight the GOP about the primary.

In his letter to Governor Dean:

Much of the back and forth and criticism of Florida by the DNC has been focused on the conduct of the Democratic legislators who – some argue – did not fight against the early primary bill. Yes, there is gambling in Casablanca. Of course we didn't fight against the bill. When the Republican leadership made it clear that this was their priority, Democrats had two choices: support something their constituents support and that was going to become law anyway; or support the DNC Rules Committee enforcement of a primary system that our constituents revile. For me, this decision was easy.


He has no way of knowing who reviles what rule, as most people don't even know the rules anyway. They had a mission, and they are still on it.

People really should care about this since Florida is trying to hurt the fundraising for the DNC and it's funding of the state parties. Most though have fallen for the "Dean is stealing our votes" mantra...it was just as easy as the argument for the WMDs in 2002.

As easy as falling off a log. Propaganda works. Truth and integrity suffer.

Bill's threat to take this to the court when there is already a Supreme Court precedent is really upsetting. The worst thing is, he does not care about the party. He cares about not being crossed.

17. Florida and Michigan have the stronger hand
The DLC will eventually have to allow the delegates (they'll save face by hosting some meaningless caucus in both states just before the convention).

Basically, the candidates can't ignore two large and critical states, the DLC needs their money, and there is the image problem of going against "counting every vote". Add in the popular support in both states for going early, and the DLC will look for some face saving "out".

What's interesting here is not this primary, but what this does for the next primary season. This will force a dramatic and long overdue overhaul of the primary process.

3. Bill Nelson never opposed Bush in 6years as much as he is speaking out against
the DNC and Dean.

Isn't it interesting that those Dem centrists who couldn't find reasons to speak forcefully AGAINST Bush all these years, have managed to find reasons to attack Dean, the DNC and fellow Democrats?

Keeping all that powder dry all these years, just so they could attack - other Democrats.

This has become a familiar theme I've seen play out the last few years. And it's always the Dems who supported Bush the most who are attacking the Dems who worked to oppose Bush the most.

5. This has become his mission. It is unbelievable to me.
So many times I have called his office, national and local. Never got anywhere on issues that were vital to us like the war and the bankruptcy bill. Now healthcare.

It is amazing how he has apparently taken this on as his goal in life. It is consuming him.

I will keep posting whatever I find out about it. Trouble is, it is something that takes paying attention to follow, but the ones who fell for the propaganda are the only ones responding now.

That's sad in itself.

He never cared about much before, but he is passionate now. I am also disappointed that the two states and their congress folks have joined forces.

This is going to hurt all of us. I am not going to vote in the primary for a presidential candidate now unless a candidate speaks up on the right side of this issue.

And there is a right side. The DNC's. Nelson's little vendetta is based on lies.

10. My guess is that if elections weren't rigged, you wouldn't feel like that.
The party infrastructure in Florida was ALLOWED to collapse through past chairs of the DNC.

You think it's a coincidence that the past chair of the DNC has been working for Hillary2008 openly since Nov2004? The KEY word being 'openly' in that sentence.

They would both vote the exact same way on ANY issue!

I'm just so proud he has a (D) next to his name. Harris may be nutz, but how do you explain Nelson? The Van Allen Radiation Belt? Subterranean Shape Shifters?

These people continue to validate why I resigned from my county DEC!

This just came in the email, and it angers me that he pretends to be promoting unity.

You are so right. He has said little about Iraq, voted for it, stood by it, never responds to anyone here....always aloof.

But he has picked a fight that will hurt us all. He is an arrogant man who needs to back off right now if he wants a lot of folks to work with the party in Florida.

This keeps popping into my mind. The connections he and his wife, Grace have to the Family, also known as The Fellowship. I shouldn't think that, but I do.

14. It appears that Nelson's office does not answer mail
from those constituents who disagree with them. One DU'er mentioned that Senators pay attention to email and snail mail. That would be difficult to prove in Nelson's case as my correspondence is not acknowledged even the snail variety. Yes, I'm fully aware that Senators do not personally answer mail, but I also know that it is standard procedure to respond even if it is only a form letter. Dean has served the Party well and any politician with half a brain should be able to see it. I guess N is simply another stubborn, power hungry sort who thinks we're all a bunch of morons who will happily believe anything he says.

This is a very good way to break the back of a part of the party financially. One suit after the other. What's amazing is that the suit is filed against the party who followed the rules. What an odd situation.

And if Bill Nelson and Michigan (heard MI might file also) do follow through....this could get costly and could break the fundraising even more.

Democratic activist sues over loss of Florida delegates

"TAMPA, Fla. -- A Tampa Democratic activist sued the national and state Democratic parties in federal court Thursday over the national party's decision to strip Florida of its delegates for next year's presidential nominating convention. Seeking to penalize Florida for moving up its primary election to Jan. 29, the Democratic National Committee's rules committee voted Saturday to take away Florida's 210 votes in the national nominating convention in Denver next summer.

Political consultant Victor DiMaio, who serves on the Hillsborough County Democratic Executive Committee, claims in his lawsuit that the action violates his constitutional rights.

"Right now we have zero delegates, so we have no voice" in choosing the Democratic nominee for president, DiMaio said.

The suit, which names the Democratic National Committee and the Florida Democratic Party as defendants, seeks clarification of the law."


Actually the Supreme Court clarified it in 1981....unless this is all geared to other motives.

Anyhow....no one seems to care enough to follow this and realize the implications. Just another way to break the activist wing.

Your state just jumped ahead of New Hampshire, and you are accusing them of holding a gun to the head of the DNC?

I don't even recognize my party any longer. It is all based on lies and propaganda.

Levin says New Hampshire has been holding a "gun" to the heads of candidates and "someone has to take on New Hampshire's transparent effort to violate DNC rules and to maintain its privileged position."

22. Could you or someone please explain this 'my vote won't count'
line?!? Our primary was moved up to the 5th, within the rules. Unless I do the jump on the bandwagon trend based on what's happened before, but rather go to vote my conscience (which I do), then how is it that my vote won't count?

What am I not understanding about this process? Even if my preferred candidate had dropped off, but I still voted for that candidate then how does this 'my vote won't count' line apply?

Perhaps I'm just being dense, but I don't understand this.

I live in California but was raised in Iowa. My liberalism was developed in Iowa. Now I worry that money that could be spent in California beating back the repuke's electoral hijacking will be spent defending against Florida's law suit. I don't believe Dean deserves this.

I checked Nelson's record and he makes LIEberman look liberal. Was he a republican in a former life? There is no insult implied. I know nothing about living in the south but he doesn't seem like much of a democrat.

Is it a good thing for all of the states pushing up primaries? I thought part of the problem in 2004 was no one had any time to try to gain momentum again. Living in California I know what it's like having the candidate chosen before your primary. The fat lady had enough time for a couple of encores before we got to vote.

I like the idea of a national primary as long as true campaign reform happens. I really hate the idea of the candidates with the most money winning and it's also why I thought Iowa and New Hampshire were first because it didn't cost major dollars to campaign in either state. I don't know if I am totally wrong or not.

And yes, money Florida gets people to withhold will impact efforts like that.

Just something else Florida will impact...and few seem to care.

He has been on the ball about these initiatives like this. Here is something about Dean and Boxer on a conference call.

Dean says CA electoral initiative is "just another Republican attempt to rig an election."

26. Maybe folks from CA should call Bill Nelson...
who is still threatening a lawsuit, even though the Supreme Court stood with the DNC on this issue in 1981.

We call him, he doesn't care. Suing your own party when you are the one in the wrong can be very painful for all involved.

28. It's a good idea really. Depriving the DNC of funds hurts us all.
I felt like I have been fighting alone. Then I find several people here have called, and that more around the state are getting angry. Problem is no one told the truth...Karen Thurman and Nelson had the young Democrats and the bloggers and the media set to go.

They have not told the truth about their positions on the primary vote. If they could have proved they voted against it and fought....they could have kept their delegates. They voted for it, and laughed.

32. All I have tried to do is get the truth out about it.
The way Florida did it was orchestrated from the beginning.

Just get across that they could have kept their delegates if they fought the GOP on it in the legislature. I am not sure of the wording but the DNC rules allows for states who are controlled by Republicans to have an opt out of sorts.

But they worked with the GOP, one Democrat at least introduced the bill and pushed it. They joked about their amendments on the floor that were supposed to keep the primary at Feb. 5. They did not even try to pretend they wanted the amendments accepted. The DNC commmittee had all the info in front of them.

Dean had tried to work with them for months, but they blew him off.

This explains what the DNC knew.

why it isn't possible to have every State hold the primary/caucus on the same day. Just like the general election: "The first Tuesday after the first Monday..."

Any state can set their primary/caucus on any date they want -- just like Florida and Michigan have done. The problem arises because selfish states like Iowa and New Hampshire demand to be first. Finally Florida and Michigan have told them to shove it. Finally someone had the courage to stop this nonsense.

34. No, that is not the truth.
There are 4 states voted on to be first....by the members of the DNC. I know the Florida member voted for it, don't know about Michigan.

It was voted on and accepted.

Florida made a power grab, lied about the DNC and Dean stealing their votes when in reality they stole their own by working with the GOP.

And they used propaganda so people like you would fall for it.

36. The DNC was blackmailed
Iowa and New Hampshire threatened to take their caucus and primary to Thanksgiving or Halloween in order to be first. Halloween would be a good date too when you see presidential candidates practically drinking ethanol in order to get some hick in Iowa to come to a caucus. This end to this nonsense was began this year by Florida and Michigan.

Florida is going for broke and saying to hell with a caucus or with working things out. Sad, because Dean has been working for them for months.

I fear this is to give a certain candidate an advantage by having the country see that Florida is coming out early for them.

Hope it doesn't backfire.
