No, wasn't it the RNC server and hosts that 'lost' them?
And it matters why they were 'lost'. If they were deleted by user with no instructions for archiving them, the hosts did their job. If they were lost through sheer negligence (as opposed to not having been accidentally kept through excessive diligence) and they were to have kept them, sure. But again, not by the US per se.
I also suspect that the number of unique e-mails is far below 5 million.
